Florida rivals ask courts to stop online sports gambling off tribal lands
online wagers on the outcome of sporting events legally on tribal land, when really only the computer servers are located there, accepting bets made using mobile phones and computers from anywhere in Florida? That's a question two of the tribe's gaming competitors are hoping the U.S. Supreme Court will take up soon and answer with a definitive “no." A decision by the nation's highest court would be of “massive importance" for the future of online gaming across the U.S., since leaving in place an appellate ruling in the tribe's favor would set a precedent for other end-runs around state prohibitions against gaming off tribal lands, said the firms, West Flagler Associates and Bonita-Fort Myers Corporation, which operate racetracks and poker rooms in Florida.

Adhir Ranjan Chowdhury questions fairness of procedure of selecting ECs
Adhir Ranjan Chowdhury, the sole Opposition representative in the search panel that selected the two election commissioners, expressed his dissent by pointing out "procedural lapses" in the selection process. He has questioned the rationale and motive of the government in providing him a list of «212 names» as probable candidates when he arrived at Wednesday midnight in Delhi and then handing him over a shortlist of «six names» just «10 minutes before the search committee meeting» on Thursday noon. In his note of dissent, Chowdhury is learnt to have questioned the rationale and fairness of the composition of the search committee by saying it ensured «no decisive say» for the sole Opposition nominee in the matter of selection as the overwhelming majority of the government representatives in the panel made the ruling side's preference «a fait accompli». During the meeting, Chowdhury is also learnt to have briefly mentioned his disappointment about the government not including the Chief Justice of India in the search committee. He reportedly pointed out that no reason has been provided for the abrupt resignation of election commissioner Arun Goel a few days ago and also the delay in filling up the second vacancy of the EC, caused by the retirement of the incumbent last month.

SC reserves verdict on whether royalty on minerals is tax
Supreme Court on Thursday reserved its verdict on the hugely contentious issue of whether the royalty payable on minerals is a tax under the Mines and Minerals (Development and Regulation) Act, 1957, and if only the Centre is vested with the power to levy such exaction or states also have the authority to impose levies on mineral bearing land in their territory. A nine-judge bench headed by Chief Justice DY Chandrachud heard the matter on eight days, while dealing with a batch of 86 appeals filed by different state governments, mining companies and public sector undertakings. The bench, also comprising Justices Hrishikesh Roy, Abhay S Oka, BV Nagarathna, JB Pardiwala, Manoj Misra, Ujjal Bhuyan, Satish Chandra Sharma and Augustine George Masih, heard the arguments of various parties including the Centre. During the hearing, the top court had said the Constitution vests the power to impose tax on mineral rights not in Parliament alone but also the states and underlined that such authority should not be diluted.

Ready to let Kerala borrow ₹5,000 crore more, Centre tells Supreme Court
Union government on Wednesday told the Supreme Court that it is ready to allow the Kerala government to borrow an additional ₹5,000 crore in the current fiscal year as a one-time measure. However, it will be subject to certain conditions to be imposed in the next financial year. Additional Solicitor General N Venkataraman also told a bench of Justices Surya Kant and KV Viswanathan that giving additional borrowing to the state in FY 2023-24 is «neither prudent nor in the interest» of the state government. Rejecting the Centre's offer, senior counsel Kapil Sibal, for the Kerala government, said that the amount was inadequate and the proposal to impose stringent conditions would amount to interference in the state's finances and borrowing powers.

Subramanian Swamy's PIL for probe against Axis Bank not maintainable, HC told
Axis Bank on Wednesday opposed before the Delhi High Court BJP leader Subramanian Swamy's public interest litigation (PIL) seeking a probe into an alleged fraud committed by the bank to make «undue profits» through sale and purchase of shares in Max Life Insurance. Senior counsel for Axis Bank as well as Max Life told a bench headed by Acting Chief Justice Manmohan that the PIL by the former BJP MP was not maintainable as the issue squarely fell in the realm of a commercial transaction between private entities. Senior advocate Mukul Rohatgi, appearing for Axis Bank and its related companies, argued that the PIL does not state the «class» of individuals for whose benefit it has been filed when the aggrieved shareholders, if any, were capable of coming to court. Senior advocate Neeraj Kishan Kaul, who appeared for Max companies, asserted that the transaction, which was a purely commercial arrangement, has been looked into by the sector regulator.
