Talking to BBC, Assistant Attorney General of the DOJ's Civil Rights Division, Kristen Clarke said that SpaceX did not hire asylum seekers and refugees because of their citizenship status. He said that it is tantamount to a ban on their hiring and it violated the federal law. He also said that the SpaceX officials took actions that discouraged the asylum seekers and refugees from seeking jobs with the space company. The lawsuit has also alleged that from September 2018 to May 2022, SpaceX routinely discouraged asylum seekers and refugees from applying and refused to hire them because of their citizenship status, which is a violation of the Immigration and Citizenship Act. The Department of Justice also said that in the job postings and public statements Elon Musk’s satellite company has falsely claimed that under the export control law, SpaceX could hire only the U.S. citizens or lawful permanent residents called the ‘green card holders’. The lawsuit also cited Elon Musk’s June 2020 post on Twitter in which he said that the U.S. law requires at least a green card to be hired at SpaceX as rockets are advanced weapons technology.
