OROP: Have decided not to accept recommendations on pension hike, Centre to SC
Centre on Thursday told the Supreme Court that it has decided not to accept recommendations for enhancing pension by 10 per cent to retired regular captains of the Army in accordance with the One Rank One Pension scheme (OROP). A bench comprising Chief Justice Sanjiv Khanna and justices Sanjay Kumar and Manmohan was apprised about the non-acceptance of recommendations on pension hike by Additional Solicitor General (ASG) Aishwarya Bhati, who appeared for the Centre. The top court was hearing an appeal of the Centre challenging an order of December 7, 2021 of the Armed Forces Tribunal (AFT) at Kochi. According to the AFT order, the central government was to take a decision on the pension payable to the retired regular captains.

SC asks CAQM to apprise it about steps taken to curb pollution, stubble burning
Supreme Court on Tuesday asked the Commission for Air Quality Management in the National Capital Region and Adjoining Areas to explain about the steps being taken to curb air pollution due to crop residue burning. A bench of Justices Abhay S Oka and Augustine George Masih asked the Commission for Air Quality Management (CAQM) to apprise about the steps on September 27, when the issue will be taken up for hearing. Senior advocate Aprajita Singh, who is assisting the court as amicus curiae, referred to some newspaper reports and said it appears that stubble burning has started in neighbouring states of Delhi. She urged the court to seek explanation from the CAQM on what steps are being taken to curb air pollution caused by stubble burning and what steps are being taken to fix accountability on officials responsible for checking the burning of paddy straw under the CAQM Act.

UAPA tribunal confirms ban on Tehreek-e-Hurriyat, Muslim League J&K faction
Muslim League Jammu Kashmir (Masarat Alam faction) and Tehreek-e-Hurriyat, Jammu and Kashmir. The one-member tribunal of Delhi High Court judge Sachin Datta was constituted under the stringent anti-terror law in January to assess whether there was «sufficient cause» behind the imposition of the ban. The Muslim League Jammu Kashmir (Masarat Alam faction) was declared outlawed for five years by the government under the UAPA on December 27, 2023 on account of being involved in anti-national and secessionist activities in the Union Territory. Founded by deceased separatist leader Syed Ali Shah Geelani, the Tehreek-e-Hurriyat was declared outlawed for five years on December 31, 2023. The organisation was banned for fomenting terrorism and spreading anti-India propaganda in Jammu and Kashmir.

SC to hear on Monday minor's plea seeking termination of 28-week pregnancy
Supreme Court is scheduled to hear on Monday a plea of a 14-year-old alleged rape victim, seeking termination of her 28-week pregnancy. As per the apex court's website, a bench of Chief Justice D Y Chandrachud and Justice J B Pardiwala will take up her case as the first item on Monday. On April 19, the top court had ordered her medical examination on the plea moved by her mother, challenging the Bombay High Court decision declining to allow the termination of the pregnancy owing to the advanced stage. It had sought a report from Mumbai's Sion hospital about the girl's possible physical and psychological condition if she undergoes medical termination of pregnancy or if she is advised against it.

Defer termination of 26-week pregnancy: SC direction to AIIMS
Supreme Court on Tuesday directed AIIMS, Delhi to defer medical termination of 26-week pregnancy of a married woman who was allowed to abort the foetus a day before by another bench. Additional solicitor general Aishwarya Bhati, appearing for the Centre, sought recall of the order passed by a bench of justices Hima Kohli and BV Nagarathna on Monday. The law officer said the termination of pregnancy was recommended despite the medical board saying that the foetus had a viable chance of being born and «they would have to conduct a foeticide».

Supreme Court Monday warned the states, which are yet to submit their response to the Centre on forming a uniform national policy on menstrual hygiene for girls studying in schools, it will take recourse to the «coercive arm of law» if they failed to do so by August 31. The warning came after the Centre informed the apex court it has so far received the response of only four states. A bench headed by Chief Justice D Y Chandrachud directed the states and Union Territories (UTs), which have failed to submit their responses, to do so positively by August 31. «The states which are in default are placed on notice that should there be any further default, this court will be constrained to take recourse to the coercive arm of law,» said the bench, also comprising Justices J B Pardiwala and Manoj Misra. Additional Solicitor General Aishwarya Bhati, appearing for the Centre, told the bench the central government has so far received inputs from only four states — Haryana, Delhi, West Bengal and Uttar Pradesh. The apex court had on April 10 asked the Centre to prepare a Standard Operating Procedure (SOPs) and formulate a national model to be adopted by all states and UTs for managing the menstrual hygiene of girls studying in schools.

Supreme Court on Friday asked the Centre to make its stand clear on whether cryptocurrency trade involving Bitcoin or any other such currencies is legal in India or not. A bench of Justices DY Chandrachud and Surya Kant, which was dealing with a case related to the quashing of multiple FIRs registered against one Ajay Bhardwaj and others for allegedly duping investors across India by inducing them to trade in Bitcoin and assuring them high returns, said that the accused were booked for their involvement in Bitcoin trade. The bench told Additional Solicitor General Aishwarya Bhati, appearing for Centre and Enforcement Directorate, «We want you to tell us on affidavit whether cryptocurrency trade involving Bitcoin or any other such currencies is legal in India or not? What is the regime for Bitcoin trade at present?» Bhati said she would file an affidavit on the legality of the cryptocurrency trade and added that the accused, who is seeking quashing of proceedings, has not been cooperating with the investigating agency after being granted bail by the court in 2019.
