SC flays Bengal Police, objects to publication of victim's name
RG Kar Medical College and Hospital, Supreme Court on Tuesday said that it was time for a «national catharsis» and that «the nation cannot await a rape or murder for real changes on the ground». It also made a fervent appeal to protesting doctors to resume work. A bench headed by CJI DY Chandrachud flayed the West Bengal Police for its inaction — registering an FIR «belatedly» and its sheer inability to deal with vandals who allegedly threatened women doctors. «We are unable to comprehend how the state was not prepared to deal with the incident of vandalisation,» the CJI verbally remarked. «The hospital is invaded. Critical facilities were damaged… A very serious offence has taken place,» the CJI said, adding that the first thing the police has to do is to protect the crime scene.

Supreme Court clears auction of Samrudhhi Realty assets to recover Rs 5,000 cr debt
Supreme Court on Tuesday gave a go ahead to the liquidator to conduct auction of the assets of Samrudhhi Realty to recover debt of around Rs 5,000 crore. However, a bench led by Justice Abhay S Oka said that if an auction of any of the assets of Essel Finance Advisors and Managers LLP is conducted, it will be subject to the final outcome of the appeal. Essel Finance had challenged the NCLAT's order that «erroneously» dismissed its appeal and upheld the NCLT's May 2024 order directing it to defray their portion of the liquidation process costs.

Centre can lower royalties to minimise impact on mining companies post Supreme Court ruling: Ambit Capital
mining retrospectively from April 1, 2005, experts have been arguing that operating costs of Indian mining companies are likely to rise significantly post the apex court ruling. Financial advisory firm Ambit Capital, however, citing a precedent, argues that there is a silver bullet that could somewhat minimize the net impact to companies from prospective dues. The financial advisory firm says that the Union Government can lower the royalty rate on mining to compensate companies.

Open Network courts can enable vast judicial process reforms
Last week, I had the privilege of attending the launch of ON Courts (Open Networked Courts) in Kerala, possibly the most creative re-imagining of the justice delivery system attempted in the country to date. Rather than merely adding new digital layers on top of existing non-digital workflows, this bold redesign of the judicial system re-examines how processes at the heart of the system ought to operate.

Kolkata doctor's rape and murder case to be heard by CJI-led Supreme Court bench today
Supreme Court is expected to hear a suo motu case, on a priority basis, related to the rape and murder of a postgraduate medic at the RG Kar Medical College and Hospital in Kolkata amid the ongoing nationwide doctors' strike over it, on Tuesday. A bench headed by Chief Justice DY Chandrachud, which had taken cognisance of the incident, has kept the matter on top of the cause list for hearing at 10:30 am on August 20, 2024. The case, officially titled "In Re: Alleged rape and murder incident of a trainee doctor in RG Kar Medical College and Hospital, Kolkata and related issue," has drawn nationwide attention. Furthermore, the Supreme Court's intervention is seen as significant, particularly because the Calcutta High Court has already handed over the investigation to the Central Bureau of Investigation (CBI).
