Howard Levitt: Recent rulings mean terminated employees may not need proof of distress for damages claims
Our employer clients often express frustration at the state of employment law. When it comes to terminating employees, the courts and legislators force employers to jump through hoops to avoid costly lawsuits. The recent decision by the Ontario Court of Appeal in only adds to the frustration of Ontario employers as the Court upheld a $50,000 aggravated (i.e., mental distress) award without a shred of expert medical or psychological evidence.

Tired of pesky calls? Soon 160 prefix for calls from banks, brokers, insurers, NBFCs, other service providers
pesky calls and SMSes, the department of telecom (DoT) has decided to allocate a separate number series — 160 — exclusively for service and transactional voice calls, as per Telecom Commercial Communication Customer Preference Regulation (TCCCPR), 2018, reported Business Line. The phone calls coming from government and regulators should have the prefix of 1600 and financial entities which are regulated by RBI, SEBI, PFRDA and IRDAI should have a prefix of 1601, Department of Telecommunications said.Apart from these principal entities (PEs), if any other entity requires assignment of number resources under this series, the same has to be requested separately by TRAI, a source, reported BusinessLine.DoT stated, telecom service providers (TSPs) have to indicate the licensing service area as part of the series in the 10-digit number provided to PEs. If a call is routed from Delhi, then the series should be 1600 (or 1601)11; if from Tamil Nadu then 1600 (or 1601)44; from Mumbai, the series would be 1600 (or 1601) 22.

DoT dials cops to stop network gear theft
DoT) has called on its enforcement units to alert all state police departments across India to clamp down on the rampant theft of critical network gear that has already triggered around Rs 800 crore of losses for telcos, disrupted 4G/5G expansions and impacted quality of mobile coverage. In a directive, dated May 27, the department has asked its field enforcement units in all licence service areas (LSAs) to also conduct quarterly reviews of the telecom gear theft situation with national law enforcement agencies. It also wants the matter to be taken up at upcoming state broadband committee meetings. The DoT directive comes after Reliance Jio, Bharti Airtel and Vodafone Idea (Vi) recently sought the government’s intervention, saying they were facing huge losses and heavy additional replenishment costs amid rising incidence of network gear theft across India. They had pointed out that expensive active telecoms infrastructure gear such as remote radio units (RRUs) and base-band units (BBUs) were being regularly stolen since October 2023.
