Jet Airways Insolvency: JKC withdraws plea to put Rs 200 cr in escrow after NCLAT refuses relief
Jalan Kalrock Consortium (JKC), the successful bidder of the grounded Jet Airways, on Tuesday withdrew its plea before the NCLAT to move Rs 200 crore, which it paid to lenders, to an escrow account. The withdrawal comes after the National Company Law Appellate Tribunal (NCLAT) refused to give any relief to JKC. An NCLAT bench headed by Chairman Justice Ashok Bhushan said the matter is already before the Supreme Court. Following this, the Consortium of Murari Lal Jalan and Florian Fritsch withdrew the appeal. «Until the shares of the corporate debtor (Jet Airways) are not issued to the successful resolution applicant (consortium), pass necessary directions requiring the MC (monitoring committee) lenders to transfer the sum of Rs 200 crore infused by SR (successful resolution applicant), in the share application account to an interest bearing escrow account,» JKC had said in its plea before the NCLAT.

HC offers relief to Pidilite in Dr Fixit dispute for now
High Court has restrained Dubond Products India from manufacturing, distributing or selling its waterproofing product that allegedly has identical trade mark/dressing of Dr Fixit until further order. Mumbai-based Pidilite Industries, the maker of Fevicol and M-Seal adhesive brands, has approached the court to restrain Dubond Products from allegedly infringing its registered trademarks, copyright and passing off for its waterproofing brand Dr Fixit LW. Passing off in intellectual property rights (IPR) law means making a false representation that is likely to induce a person to believe that the goods or services are those of another. «The balance of convenience is overwhelmingly in favour of the plaintiff (Pidilite). Further, irreparable harm and loss will be caused to the plaintiff due to the defendant's continued use of the marks which are wrongful activities,» observed Justice RI Chagla in its order of May 21. «The defendant has various other products apart from the impugned product and therefore the defendant's business will not be affected upon the grant of injunction,» he said further in a 81-page order.

Rajkot Gaming Zone fire tragedy, the Gujarat High Court came down heavily on the civic body on Monday and said that all the municipal commissioners, right from the time the TRP game zone was set up in 2021 till the time of the incident, should be held responsible for the incident. Saying that the HC could no longer trust the state machinery which reacts only after loss of innocent lives, the division bench comprising Justices Biren Vaishnav and Devan Desai asked the municipal commissioners to file individual affidavits. The court further asked the Chief Fire Officers of Ahmedabad, Vadodara, Surat and Rajkot municipal corporations to file affidavits regarding fire safety measures within their respective areas.

Delhi HC upholds order asking SpiceJet to return two leased aircraft, three engines
division bench of the Delhi High Court on Monday upheld its single judge’s order asking SpiceJet to return two aircraft and three engines to its lessor TWC Aviation. While dismissing the airline’s appeal as withdrawn, a bench led by Justice Rajiv Shakhder granted the low cost carrier three weeks time till June 17 to return the aircraft and engines along with technical records. The single judge had asked SpiceJet to return the engines by May 28. The HC noted SpiceJet’s sr counsel Amit Sibal’s argument that he wants to advance his submission related to the jurisdiction issue before the single judge, but that will not come in the way of returning the engines.

Delhi HC directs DDA to formulate comprehensive SOPs for booking of Ramleela Sites within 5 weeks
Delhi High Court has directed the Delhi Development Authority (DDA) to formulate comprehensive SOPs (standard operating procedure) and guidelines for booking Ramleela sites within five weeks from the date of order and no later than June 25, 2024. The bench of Justice Tara Vitasta Canju in an order passed last week stated that, «The DDA shall formulate comprehensive SOPs/guidelines for booking of Ramleela sites within five weeks from the date of this order and no later than June 25, 2024. In the event, the DDA seeks to rely on the list of Delhi Dharmik Mahasangh (DDM) or other third part organisations for these bookings, an appropriate clarification would be in the SOPs/guidelines to make all persons aware of such reliance. These SOPs/guidelines shall be publisiced by DDA.» In the meantime, no online/offline bookings of DDA ground/open spaces for Ramleela functions, shall be undertaken by DDA, till the new SOPs/guidelines for booking of Ram Leela sites is published, said the court.

Gujarat High Court has taken suo motu cognizance of the incident and the PIL will come up for hearing on Monday. A special bench of the Gujarat High Court, comprising Justice Biren Vaishnav and Justice Devan Desai, observed that «prima facie, a man-made disaster has occurred where innocent lives of children have been lost» as such recreation facilities have come up without adequate approvals from the competent authorities. «The gaming zone in Rajkot appears to have taken advantage of the loopholes in the Gujarat Comprehensive General Development Control Regulations to pave its way for creating illegal recreational activities,» the bench. It stated that it has also taken note of such gaming zones that have come up in Ahmedabad «which pose significant threat to public safety, especially to innocent children.»

The bench directed advocates of the Ahmedabad, Vadodara, Surat and Rajkot municipal corporations to appear before it on Monday with instructions as to under what provisions of law the authorities led these units to be set up or continue to operate under their jurisdiction. Four children under the age of 12 were among the 27 persons killed and three others injured in the massive fire that swept through the game zone in Rajkot teeming with people enjoying a summer vacation outing on Saturday evening, as per the officials.
