UPS Provident Action Justice reports Courts Manipur violence: Cases to be tried in Guwahati itself, says SC
Supreme Court on Monday said the trial of the Manipur ethnic violence cases, probed by the CBI, would be conducted in Guwahati, Assam, where it was transferred to earlier. A three-judge bench headed by Chief Justice Sanjiv Khanna also extended till July 31, 2025, the tenure of a committee headed by Justice Gita Mittal, the former chief justice of the Jammu and Kashmir High Court. The panel, also comprising former Bombay High Court judge Shalini P Joshi and Asha Menon, former Delhi High Court judge, was set up on August 7, 2023 by the top court to oversee relief and rehabilitation of the victims of ethnic violence in Manipur. The tenure of the panel was previously extended by the top court by six months on August 5, last year. On Monday, the bench noted the submissions of a lawyer over the fate of the trials in the cases that were transferred to Guwahati for pre-trial proceedings by the bench on August 25, 2023. «We clarify that the trial of transferred cases will be held before the courts at Guwahati,» the CJI said.

Chief Election Commissioner and an election commissioner last month, needless questions are being raised on whether they were the right individuals for these offices because the Chief Justice of India was not on the selection committee. Argument being that the CJI's exclusion has rendered the selection one-sided as the Leader of Opposition is in the obvious minority. This logic is spurious. Article 324 (2) of the Constitution that outlines the composition and appointment of the CEC and ECs reads as follows: «The Election Commission shall consist of the chief election commissioner and such number of other election commissioners, if any, as the President may from time to time fix and the appointment of the chief election commissioner and other election commissioners shall, subject to the provisions of any law made in that behalf by Parliament, be made by the President.» The President has been appointing the CEC and ECs on the advice of the executive, that is the government of the day. Parliament has not enacted any law to amend this process. The LoP's inclusion in the selection committee for the appointment of any regulatory position started with the Right to Information Act, 2005. Under this law, the President appoints central information commissioners on the recommendation of not the executive but a selection committee comprising the Prime Minister, a minister nominated by him and the LoP in the Lok Sabha. In state information commissions, the governor makes the appointment on the recommendation of a committee comprising the chief minister, a minister and the LoP of the state assembly.

Chief Justice Alok Aradhe and Justice Bharati Dangre, in their ruling on Thursday, emphasized that the implementation of FASTag is a well-considered policy decision aimed at ensuring efficient and smooth road travel. «The system of FASTag, introduced in 2014, is here to stay,» the judges remarked, stating that there was no legal basis to intervene in the Centre's policy, which is being carried out by NHAI. Khanapure had filed the PIL after NHAI's circular in February 2021, which made it mandatory for all vehicles to use FASTag to pass through toll plazas. He had urged the court to keep at least one toll lane for hybrid payment options, such as cash.

This troubling development comes despite legislative mandates designed to expedite trials, primarily due to the absence of sufficient dedicated courts to handle such cases. The alarming statistics were revealed in response to a Right to Information (RTI) application filed by city-based activist Vihar Durve on February 6, 2025, requesting details on the pendency of POCSO-related cases in the state. A reply provided by the Bombay High Court’s Public Information Officer on March 4 disclosed that the number of pending cases rose from 32,988 at the beginning of 2023 to 41,977 by January 31, 2025. This increase occurred even as laws stipulate the fast-tracking of cases involving child victims. The backlog has been growing significantly each year. In 2024 alone, 12,838 new cases were registered, while only 7,942 were resolved, contributing nearly 5,000 additional cases to the pile. The pendency rate has risen by 11.2% in 2023 and 13.3% in 2024, with 405 new cases added to the backlog in the first month of 2025 alone.

Centre for Public Interest Litigation, also sought direction of the court mandating that the CAG shall be appointed by the President in consultation with an independent and neutral selection committee comprising of the prime minister, the Leader of the Opposition (LoP) and the Chief Justice of India and in a transparent manner. It said that the direction for appointment of CAG should be similar to the appointment of other bodies including Information Commissions and the Central Vigilance Commission. The PIL will be taken up for hearing on Monday by a bench of justices Surya Kant and N Kotiswar Singh. The plea filed through advocate Prashant Bhushan contended that the present mode of appointment of the CAG, which is done solely by the executive i.e. by the prime minister who handpicks any individual and recommends his name to the President for appointment, is unconstitutional as it is violative of Article 14 and several basic features of the Constitution. «The appointment of the Comptroller and Auditor General of India solely by the executive and the Prime Minister of India undermines the independence of the office of the CAG, suffers from grave conflict of interest and thereby is detrimental to good governance and democracy in India. It is also manifestly arbitrary, detrimental to institutional integrity and violates several basic features of the constitution,» the plea said.

Three citizen organisations had filed a public interest litigation (PIL) in the HC contending that section 17 (2) of the Act was «mutilating» the Regional Plan. Notified in March 2023, the section was aimed at allowing the authorities to correct inadvertent errors or rectify inconsistent or incoherent zoning. The Regional Plan is a long-term land-use development blueprint prepared by the Town and Country Planning Department of Goa to guide infrastructure, zoning, and environmental conservation in the state. A division Bench of Justices Nivedita P Mehta and M S Karnik on Thursday struck down section 17 (2), holding that it was not in «furtherance of development in the public interest by maintaining a balance between sustainable development vis-a-vis environmental issues», but was concerned with private land owners' interests. The petitioners had argued that the section was being misused to change the status of large tracts of land for commercial purposes. According to the state, between March 2023 and January 2 of this year, there have been 353 approvals under section 17(2) which affect an area of about 26,54,286 square metres, noted the bench.

A bench of Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela also requested the single judge, hearing the wrestlers' plea against the 2023 WFI election, to expedite the proceedings. The Centre on March 10 revoked its order suspending the WFI on December 24, 2023 for lapses in governance and procedural integrity by the new body, elected on December 21, the same year, and restored its status as a national sports federation. The bench, while closing the proceedings on WFI's appeal against the single judge's order on restoring Indian Olympic Association's (IOA) ad-hoc committee to run its affairs, observed the committee had to work only till the Centre's suspension was in force. Referring to the March 10 decision, the court observed nothing remained to be adjudicated in the WFI appeal. «Needless to state, it will be open to any party, if aggrieved by the order dated March 10 passed by the sports ministry, to challenge the same before appropriate court,» it said.
