Preventive detention based on capricious exercise of powers must be nipped in bud: SC
preventive detention is a draconian measure and any such move based on a capricious or routine exercise of powers must be nipped in the bud, the Supreme Court has set aside a Telangana High Court order rejecting a detenu's appeal. A bench headed by Chief Justice of India D Y Chandrachud on Thursday said the essential concept of preventive detention is that the detention of a person is not to punish him for something he has done but to prevent him from doing it. «Inability on the part of the state's police machinery to tackle the law-and-order situation should not be an excuse to invoke the jurisdiction of preventive detention,» the bench also comprising Justice J B Pardiwala and Justice Manoj Misra said. «Preventive detention being a draconian measure, any order of detention as a result of a capricious or routine exercise of powers must be nipped in the bud. It must be struck down at the first available threshold,» the top court said.

'New income tax regime is yet to have any meaningful impact on ELSS schemes': AMC Expert
Edited Excerpts of an interview with Livemint 1) How do you assess the current domestic and global market conditions, and what factors are you closely monitoring? Inflation and geopolitical tension are the main factors impacting the global economy at present. US inflation, still hovering above the 3% level is proving to be stickier and more persistent, hence rates are likely to remain higher for the time being and any cut is unlikely in 1HCY24. To add to the concerns, the Red Sea attack by the Houthis added to higher freight rates across the globe.

Allahabad High Court strikes down UP Madrasa Act
Allahabad High Court on Friday declared the UP Board of Madrasa Education Act, 2004, as unconstitutional, ruling that it was violative of the principle of secularism, articles 14, 21, 21-A of the Constitution as well as section 22 of the University Grants Commission, Act of 1956. The court, considering the large number of madrasas and madrasa students in the state, directed the state government to accommodate these students in regular schools recognised under the primary, high school and intermediate education boards of the state. It also said that additional seats be created (in these schools) and even new schools be established, if needed. The court gave the verdict on a plea filed by advocate Anshuman Singh Rathore, who had challenged the constitutionality of the law passed by the then Mulayam Singh Yadav government .«No doubt the state has sufficient power to frame laws with regard to education to be provided at school level, both primary and thereafter up to intermediate; however, such education has to be secular in nature,» the court said. «The state has no power to create a board for religious education or to establish a board for school education only for a particular religion and philosophy associated with it. Any such action on part of the state violates the principles of secularism, which is in the letter and spirit of the Constitution of India.»

Lok Sabha Elections: No deal with BJD; BJP to fight polls on 'Odiya pride' plank
BJP on Friday decided to go alone in the upcoming Lok Sabha as well as assembly polls in Odisha after holding several rounds of discussion for a possible alliance with the BJD. As per sources, the BJP leadership, after getting a grassroots-level feedback on the prospects of the alliance in Odisha, felt that an alliance would benefit the BJD more than the BJP. Serious deliberations have been going on in the BJP for quite some time to explore the possibility of an alliance between the two parties. Sources in the BJP told ET that efforts were made by the top leadership of both the parties over an alliance in the state. Ever since VK Pandian, former IAS officer and the close aide of Odisha chief minister Naveen Patnaik joined politics, there was a murmur over an outsider taking control of the BJD as well as the state.

ED says Arvind Kejriwal 'Key conspirator, kingpin', gets custody till Thursday
Delhi chief minister Arvind Kejriwal to custodial interrogation of the Enforcement Directorate till March 28. Terming Kejriwal as «kingpin and key conspirator» in the Delhi excise policy case, ED had sought 10 days' custody. Significantly, the remand paper filed by ED alleged that «Aam Aadmi Party has committed the offence of money laundering» through Kejriwal. This is the first time that the federal agency has accused AAP of money laundering in a court of law. As reported by ET on January 7, ED was contemplating invoking Section 70 (1) of PMLA to make AAP an accused in the case. As per the section: «Where a person committing a contravention of any of the provisions of this Act or of any rule, direction or order made thereunder is a company, every person who, at the time the contravention was committed, was in charge of, and was responsible to the company, for the conduct of the business of the company as well as the company, shall be deemed to be guilty of the contravention and shall be liable to be proceeded against and punished accordingly.»

Why are women both sadder and happier than men?
I have a good job, a loving husband, healthy kids and a comfortable home. I came late to it all and I sometimes can’t believe my luck: that the sleep-warm little bodies I help dress in the morning are my own children, that the man in my bed at night helped me make them. But the clichés about motherhood and aging and that ever-elusive work-life balance did not quite prepare me for the clichés of my life.

Hard to get, or anti-competitive?
Hermes is facing a class-action suit in California for 'forcing' customers to buy more of its accessories and trot up a 'sufficient purchase history' if they hope to purchase the French luxury design house's iconic Birkin bag. The plaintiffs are arguing this is anti-competitive behaviour that coerces consumer behaviour to become eligible for a 'sale'.
