Cal HC directs Centre to file affidavit on PIL alleging deactivation of Aadhaar cards
Calcutta High Court on Thursday directed the Centre to file an affidavit on a PIL alleging deactivation of Aadhaar cards of people by the authorities concerned. Additional Solicitor General (ASG) Ashoke Chakrabarti questioned the maintainability of the PIL, stating that no individual case of any person affected by such a deactivation has been cited in the petition. A division bench headed by Chief Justice T S Sivagnanam directed the Centre to file the affidavit within three weeks stating its position on the allegation made in the PIL, which claimed that Aadhaar cards of people were being deactivated in an arbitrary manner using provisions under Section 28A of the Aadhaar Act. Directing the petitioner to file their affidavit a week after that, the bench, also comprising Justice Hiranmay Bhattacharyya, said that the matter will be taken up for hearing again on April 25.

Ensure no more WhatsApp messages on ‘Viksit Bharat’ are sent, ECI tell IT ministry
Election Commission of India (ECI) has asked the ministry of electronics and information technology to ensure that no messages regarding the Viksit Bharat Model are delivered to the WhatsApp numbers of users from today keeping in view the ongoing model code of conduct (MCC) before the 18th general elections, scheduled to take place between April and June. “The Commission has received complaints from various quarters that such messages are still being delivered on citizens' phones. Since the MCC is now in force, you are hereby directed to ensure forthwith that no further delivery of 'WhatsApp messages' take place during MCC period. A compliance report in this regard may be sent immediately,” the ECI letter to the IT ministry said.

Banks should pass reasoned orders while declaring entity/person wilful defaulter, says Bombay HC
Bombay High Court has said banks and financial institutions should pass reasoned orders before declaring an entity or person a wilful defaulter under the Reserve Bank of India's Master Circular. A division bench of Justices B P Colabawalla and Somasekhar Sundaresan, in its order on March 4, noted that wilful defaulters are ostracized from access to the financial sector and hence, the discretion given to banks under the circular should be exercised with caution as mandated by the RBI. «Banks and financial institutions that seek to invoke the Master Circular to declare occurrence of wilful default, must share the reasoned orders passed by its Identification Committee and Review Committee,» the HC said. The bench was hearing a petition filed by Milind Patel, former joint managing director of IL&FS Financial Services Limited (IFIN), challenging an order passed by the Union Bank of India in February 2023 declaring the firm and its promoters wilful defaulters under the 2015 Master Circular issued by the RBI.
