Gragson will not participate in the upcoming Cup Series race at Michigan International Speedway, and his spot will be filled by Josh Berry. The Legacy Motor Club released a statement via social media, expressing their immediate suspension of 25-year-old Gragson, citing his actions as inconsistent with their team's values. According to Fox Sports, Gragson's suspension was triggered by his liking of the controversial meme that made light of George Floyd's 2020 murder, a deeply divisive incident that sparked global conversations on racial issues. NASCAR also weighed in on the matter, pointing out that Gragson's conduct violated Section 4.4.D. of the NASCAR Rule Book, which addresses driver behavior. NASCAR's official statement supported the Legacy Motor Club's decision, highlighting Gragson's breach of the Member Conduct section in the 2023 NASCAR Rule Book. This violation led to his indefinite suspension. Gragson, while apologizing on X, said, «I am disappointed in myself for my lack of attention and actions on social media. I understand the severity of this situation. I love and appreciate everyone. I try to treat everyone equally no matter who they are. I messed up plain and simple.» Replacing Gragson, Josh Berry, an experienced 32-year-old driver, will take the wheel of the No. 42 Legacy MC Chevrolet at the FireKeepers Casino 400 event.
