In setback for lenders, Supreme Court dismisses pleas over govt dues under IBC
State Bank of India and Indian Overseas Bank, seeking recovery of their dues, the Supreme Court on Tuesday dismissed their petitions seeking a review of its earlier judgement that statutory creditors like tax authorities and government agencies would be considered secured creditors under the Insolvency and Bankruptcy Code (IBC). A Bench comprising justices Justices AS Bopanna and Bela M Trivedi while affirming its last year’s view said it had considered the waterfall mechanism and the other provisions of the Code before arriving at its decision for deciding the priority for distribution of sale proceeds of assets, etc. The case does not “fall under the ambit of review,” it said. On September 6 last year, the top court ruled that any insolvency resolution plan, approved by the financial creditors by ignoring the statutory demands payable to state and Central governments or other legal authorities, was liable to be rejected.

Total insensitiveness: SC stays Allahabad HC order
A bench of justices BR Gavai and Augustine George Masih had taken suo motu cognisance of the Allahabad HC ruling on Tuesday. «We are at pains to state that it shows total lack of sensitivity on part of the author of the judgement. It (the order by high court) was not even at the spur of the moment and was delivered four months after reserving the same. Thus, there was application of mind,» the bench verbally remarked. The bench further orally observed: «We are usually hesitant to grant stay at this stage. But since observations in paragraphs 21, 24 and 26 is unknown to canons of law and show an inhuman approach, we stay the observations in said paras.» Solicitor general Tushar Mehta said there are enough reasons to stay the order. «Some judgements contain reasons for staying them. It has the same,» Mehta added.

Sub-classification of Scheduled Castes for quota: SC dismisses pleas seeking review of judgment
Supreme Court has dismissed a batch of pleas seeking review of its judgment which held that states are constitutionally empowered to make sub-classifications within the Scheduled Castes for granting reservation. A seven-judge Constitution bench comprising Chief Justice D Y Chandrachud and Justices B R Gavai, Vikram Nath, Bela Trivedi, Pankaj Mithal, Manoj Misra and Satish Chandra Sharma said there is no error apparent on the face of the record. The top court also rejected applications for listing the review petitions in open court. Justice Trivedi, who had written a separate dissenting judgment in the case, was also part of seven-judge bench which dismissed the pleas seeking review of the majority verdict.

Supreme Court is scheduled to consider in-chambers on Tuesday a batch of pleas seeking review of its judgement which held that states are constitutionally empowered to make sub-classifications within the Scheduled Castes, which form a socially heterogeneous class, for granting reservation. As per the cause list, a seven-judge Constitution bench comprising Chief Justice D Y Chandrachud and Justices B R Gavai, Vikram Nath, Bela Trivedi, Pankaj Mithal, Manoj Misra and Satish Chandra Sharma is likely to take up the matter at 1.35 pm. On August 1, the top court had held that states are constitutionally empowered to make sub-classifications within the Scheduled Castes, which form a socially heterogeneous class, for granting reservation for the uplift of castes that are socially and educationally more backward. The apex court, however, made it clear that states have to make sub-classification on the basis of «quantifiable and demonstrable data» of backwardness and representation in government jobs and not on «whims» and as a matter of "political expediency".

SC directs Sahara group to submit property sale plan for investor refund by Thursday
Supreme Court on Tuesday asked the Sahara group to submit a “scheme” for the sale of its immovable, domestic and offshore properties by Thursday. This is to raise money for refund of more than Rs 24,029 crore collected by its two entities — Sahara India Real Estate Corporation Ltd (SIRECL) and Sahara Housing Investment Corporation Ltd (SHICL) — from 3.3 crore bond investors, with an interest of 15% from March 2008, as directed by the apex court in a series of orders since August 2012. A bench comprising Justices Sanjeev Khanna, Bela Trivedi and MM Sundresh told Sahara’s senior advocate Kapil Sibal that “more than 10 years have passed, and you still haven't deposited the money… SEBI is seeking the remaining Rs 10,000 crore. How will you muster the remaining Rs 10,000 crore?” Sibal said that Sahara group did not have a fair opportunity to sell its properties to pay the balance amount and no one wanted to “touch its properties.”

Merely being not named in predicate offence doesn't mean one can't be prosecuted under PMLA: Supreme Court
predicate offence does not mean that he cannot be prosecuted under the Prevention of Money Laundering Act (PMLA), the Supreme Court said on Friday while hearing a plea in a money-laundering case arising out of the alleged coal-block allocation scam. The observation came from a vacation bench of Justices Bela M Trivedi and Pankaj Mithal, which was hearing a petition filed by one Sudhir Gupta seeking quashing of an Enforcement Case Information Report (ECIR) against him and the subsequent proceedings arising out of it. The bench told advocate Vijay Aggarwal, who appeared in the court on behalf of Gupta, that the Enforcement Directorate (ED) ECIR could neither be quashed nor stayed. Aggarwal told the bench that the petitioner was arrayed as a witness in a related case lodged by the Central Bureau of Investigation (CBI), but the ED has made him an accused in the money-laundering case.

Skill development corporation case: SC to hear plea by AP govt against Chandrababu Naidu's bail on May 7
Supreme Court will hear on May 7 a plea filed by the Andhra Pradesh government challenging a high court order granting regular bail to TDP chief N Chandrababu Naidu in the skill development corporation scam case. The petition came up for hearing on Tuesday before a bench of Justices Bela M Trivedi and Pankaj Mithal which noted the counsel for the state has said they have filed an interlocutory application (IA) in the matter. It observed the said application does not appear to be part of the record. «In view of the above, the Registry is directed to do the needful. List the IA and the special leave petition on May 7, 2024,» the bench said in its order.

Skill development scam: Supreme Court verdict on January 16 on Chandrababu Naidu's plea for quashing FIR
Supreme Court is scheduled to pronounce its verdict on Tuesday in a plea filed by former Andhra Pradesh Chief Minister Nara Chandrababu Naidu seeking to quash the FIR and criminal proceedings against him in the Skill Development scam case. Justices Aniruddha Bose and Bela M Trivedi will deliver the verdict on January 16 at 1 pm on a special leave petition filed by the Naidu against the Andhra Pradesh High Court's order of September 22, 2023, denying him relief. The top court had reserved the order on the plea for October 17, 2023. West Bengal government to respond to an anticipatory bail plea filed by Union minister of state for home affairs Nisith Pramanik in connection with an attempt to murder case lodged against him in 2018.
