Provident Pool exclusive information Equality rights Some PE, VC investors more equal than others? Sebi seeks to find out
private equity (PE) and venture capital (VC) investors more equal than others? The capital market regulator has asked several funds to reveal the names of investors who have been offered beneficial terms by the funds and have representation on the funds' investment committees. Many PE and VCs — or, alternative investment funds (AIFs), the regulatory term for such pooled vehicles — have been told to spell out the details of these differential rights given to certain investors. In a communique to many AIFs about a week ago, the Securities & Exchange Board of India (Sebi) asked fund managements to submit documents like 'side letters' and 'contribution agreements' that provide special rights to investors. The regulator may compare a side letter, which is an agreement between a fund house and some investors, providing rights and obligations which are outside the standard investment document, with the fund's private placement memorandum (PPM) — the disclosure document used for fund raising through private offering.

Progressive wellness Equality rights Sporting athletics badminton From 1 to 22: The rise of Paralympians
India won its 20th medal at the Paris Paralympics, surpassing Tokyo’s 19 — medal mark. On Wednesday, Sachin Sarjerao Khilari – silver in men’s shot put F46 event — and Harvinder Singh — gold in men’s individual recurve open — added two more medals to push India’s count to 22. Considering that there was only one medal in London 2012 and just four in Rio 2016, the progress is staggering. Naturally, the rise in medals has coincided with the increase in the number of Indian athletes qualifying for the Paralympics. In another positive development, women athletes have outperformed men on many occasions. In Tokyo, all four badminton medals were won by men (Pramod Bhagat, Krishna Nagar, Suhas Yathiraj and Manoj Sarkar). In Paris, however, three women – Thulasimathi Murugesan, Nithya Sre Sivan and Manisha Ramadass – have made it to the podium, while only two men won the medals.

markets UPS Target security Trade Equality Courts View: In India, some mergers and acquisitions are more equal than others
short seller and the Indian market regulator, a completely different controversy is brewing. It involves the country’s second-most-valuable bank, and its plan to swallow up its securities affiliate. Some shareholders of the brokerage firm, upset over the terms of the buyout, want to know how the Securities and Exchange Board of India allowed the delisting of ICICI Securities Ltd., waiving the regulator’s own rules for compensating minority investors. A company-law tribunal in Mumbai quashed their challenge on Aug. 21 and allowed the deal to proceed. But that isn’t the end of the matter. There is a separate class-action suit before another tribunal in New Delhi. This dispute is also being heard by a higher court in Mumbai, the country’s commercial capital. The Indian regulator is battling bigger trouble elsewhere. In an Aug. 10 note, Hindenburg Research drew attention to SEBI chief Madhabi Puri Buch’s past personal investments, and her ownership of a consulting outfit, to question the watchdog’s objectivity in probing the Adani Group, the target of the short seller’s original January 2023 report. The infrastructure conglomerate, which suffered a $150 billion drop in its market value in the aftermath of the publication, has strenuously denied the short seller’s claims of stock-price manipulation. The group’s shares have recouped most of their losses. Buch described the allegation of potential conflict as “character assassination” and said that she made all the appropriate disclosures and recusals.
