In a stunning ruling Friday, U.S. District Court Judge Paula Xinis gave the government just 72 hours—until the end of the day Monday—to bring Kilmar home. The courtroom erupted in applause as the judge demanded action after weeks of silence and confusion.
“We concede the facts. The plaintiff should not have been removed,” said a Justice Department lawyer, offering no explanation for the lack of a removal order or arrest warrant. Judge Xinis called the deportation an illegal act and made it clear: Kilmar had legal permission to stay in the U.S. In fact, an earlier court order explicitly said he must not be deported to El Salvador under any circumstances.
Despite that, ICE removed him anyway, later claiming it was an «oversight» made in «good faith.»
