A lawsuit filed by public interest group National Security Counselors alleges that DOGE is in violation of the Federal Advisory Committee Act (FACA), a law enacted in 1972 to ensure transparency and fairness in government advisory bodies.
The lawsuit, filed on the very day of Trump’s inauguration, accuses DOGE of failing to comply with federal requirements such as maintaining balanced membership, keeping public records, and conducting open meetings, as mentioned in a report by Forbes.
The case marks the first legal hurdle for the newly sworn-in Trump administration, which had touted DOGE as a cornerstone of its plans to streamline government operations.
According to the National Security Counselors, DOGE qualifies as a federal advisory committee under FACA because it seeks input from individuals outside regular federal employment to influence government operations.
