Go First’s resolution professional was directed by the National Company Law Tribunal on Friday to file an additional affidavit within the next 10 days, which shall also include a report on the maintenance of assets. The lessors in six applications, where pleadings have been completed, informed the tribunal that maintenance of assets as directed by the tribunal in its earlier order was not taking place and requested that the RP include a report on maintenance of assets in the additional affidavit.
The tribunal said that noted that as this was a serious matter, a report on maintenance could be included in the additional affidavit to be filed by RP of Go First. The senior counsel appearing for Go First’s resolution professional informed the tribunal that given the lessors had «engaged the airline in different fora» and “far too many developments had taken place”, an additional affidavit was not placed on record.
The senior counsel informed the bench that one of the lessors, which NCLT denied relief, had approached the Delhi High Court to restrict Go First from maintenance and operations, and another had approached the National Company Law Appellate Tribunal (NCLAT) against the NCLT’s interim order to restrain Go First from flying and operating aircraft and engines. The NCLT, in its order dated July 26, had said that as long as engines/aircraft were registered, they could be used by the beleaguered airline to operate as a going concern.
