Dhananjaya Y. Chandrachud on Friday said that the greater challenge for the Indian judiciary is that the constitution and rights become accessible to common people.
The chief justice while delivering the inaugural address at the 19th All India Legal Services Authorities Meet here in Srinagar said the question of access to justice assumes importance particularly for the poor and marginalised. The CJI stressed that not only judges but the whole legal fraternity have a salient role in demystifying and simplifying legal processes for citizens to make them more accessible to common citizens particularly those belonging to marginalised communities.
He said that the choice of the venue for this significant meeting in Srinagar from the perspective of the Indian judiciary reflects the mainstreaming of Jammu, Kashmir and Ladakh in the discourse of development in India. The Supreme Court judges, union minister of law and justice Arjun Ram Meghwal, Lieutenant Governor of Jammu and Kashmir Manoj Sinha and LG of Ladakh Brig ® B D Mishra and judges across the country were present in the function.
“Many legal processes in our country are complex by structure design. For many people the basic act of filing an FIR becomes daunting because of various social and economic barriers…These barriers which prevent citizens from achieving the ideals of the constitution,” said the CJI.
He said that the district legal service authority has bridged the gap between the citizens and legal system and emerged as the backbone of our legal services framework. “703 DLSAs functioning across India…It is important that we institutionalise processes…it is important that judicial institutions are not individual driven…We have to institutionalise what we adopt
