Citizens Merit WhatsApp Justice Courts rights Article 21 soul of Constitution, liberty of citizen paramount, says SC
Supreme Court has said that Article 21 is the soul of the Constitution as the liberty of a citizen is of paramount importance and the high court not expeditiously adjudicating matters related to it would deprive a person of this precious right. A bench of Justice B R Gavai and Justice Sandeep Mehta made the observation after noting that the Bombay High Court has granted bail to one Amol Vithal Vahile, a prime accused in the murder of a corporator in Maharashtra, after a nudge from the apex court on January 29. The bench, in its recent order, said it is thus clear that before the order was passed by this court on January 29, 2024, the high court instead of deciding the application for bail on merits shunted it on one or the other ground. «Needless to state that Article 21 of the Constitution of India is the soul of the Constitution as the liberty of a citizen is of paramount importance. Not deciding the matter pertaining to liberty of a citizen expeditiously and shunting away the matter on one or the other ground would deprive the party of their precious right guaranteed under Article 21 of the Constitution of India,» it said.

Mumbai bench of Income Tax Appellate Tribunal has allowed ICICI Bank Ltd to avail ₹1,855 crore bad debt write-off as deduction, but dismissed the private bank's appeal seeking ₹502-crore worth long-term capital loss allowance. The appellate tribunal was hearing ICICI Bank's appeal against an order of principal commissioner of Income tax (PCIT) for 2015-16. The PCIT had ruled that an allowance of long-term capital loss of ₹996 crore was irregular and that the bank had claimed an excess capital loss of ₹502 crore. The bank had calculated capital gain and capital loss while acquiring and selling shares, applying the cost of inflation index on foreign currency rather than Indian currency, it said. The ITAT bench of Sandeep Singh Karhail and Prashant Maharishi upheld the order of PCIT and observed that ICICI Bank transacted in Indian currency and, therefore, it could not have indexed the cost of inflation on foreign currency.

AAP on Tuesday declared that it is willing to cede only one of seven parliamentary seats in Delhi to Congress and announced candidates for two seats in Gujarat and one in Goa, pushing the opposition INDIA bloc to the brink of collapse. A key driver of its profit growth was other — or non-interest — income which, excluding treasury, rose 20% to ₹5,975 crore, led by 19% growth in fee income. Net interest income (NII) — or the difference between interest income earned on loans and that paid for deposits — rose at a slower 13% to ₹18,678 crore, largely reflecting the weaker NIM which eased to 4.43% from 4.65% a year earlier. HDFC Bank, the nation's largest lender by market value, also on Tuesday reported a smaller net interest margin, even as its net profit rose 34% year-on-year. ICICI Bank executive director Sandeep Batra shrugged off the reduction in margin as an industry phenomenon due to rising deposit rates.
