flat from renowned builders, it's generally expected that they will adhere to the agreed payment schedule. However, a non-resident Indian (NRI) residing in London encountered an unfortunate situation with Godrej Properties. The builder requested 60% payment for the flat almost six months before the initially proposed deadline in December 2017. Unable to meet the new deadline, the NRI's flat booking was cancelled in March 2018 by the builder, who allegedly forfeited the NRI's Rs 97 lakh advance payment. Despite the NRI's plea to not cancel the booking, the builder asked for Rs 3.17 lakh as reinstatement fees and Rs 9 lakh as interest in April 2018. The NRI did not agree to the above terms and asked the builder to refund Rs 97 lakh he had already paid when the agreement for sale was registered in 2016. However, the builder refused to pay any money and cited legal terms and conditions. It was later proved in MahaRERA courts that after cancelling the NRI's flat booking, the builder resold these flats to another person for 'substantially' more money. «The Promoter forfeited the amount of Rs 56,66,800/- as per Clause 13(6) of the agreements for sale and did not refund the balance amount,» alleged the NRI in MahaRERA.

district court in Pune has dismissed an application filed by the US fast-food major Burger King Corporation (BKC) to restrain its local namesake from using the trademark ‘Burger King’ In an over 13-year-old case, district Judge Sunil G. Vedpathak, while dismissing the US fast-food major’s petition also dismissed the counterclaim filed by the Pune-based firm. “Admittedly plaintiff (BKC) has registered its trade mark Burger King under class 42 pertaining to restaurant services as of October 6, 2006. So, considering the fact that defendants are prior users of the trademark in question, I am of the opinion that the plaintiff has no cause of action to seek relief of perpetual injunction,” said the court in his 57-page order. “Thus, in the absence of cogent evidence, I find that the plaintiff is not entitled to damages, rendition of accounts and the relief of perpetual injunction,” it further added.

Burger King Corporation has lost a 13-year-old legal battle against its namesake eatery in Maharashtra's Pune after a district court dismissed a suit filed by the company alleging trademark infringement. Pune district judge Sunil Vedpathak, in the order on August 16, said the city-based eatery 'Burger King' was operating even before the US burger joint opened shop in India and that the latter failed to prove the local food outlet had infringed its trademark. The court dismissed the 2011 suit filed by the Burger King Corporation, seeking a permanent injunction restraining infringement of trademark, passing off (the trademark as theirs), as well as monetary damages. The suit, filed against Anahita Irani and Shapoor Irani, owners of the Pune-based Burger King food joint, also sought Rs 20 lakh as damages.

Acil Ltd, despite an overwhelming number of creditors with a majority vote of 88.56% approving it in August 2019. While asking the NCLT to pass appropriate orders in terms of its Tuesday’ judgment on giving nod to the Ramkrishna Forgings' approved resolution plan within three weeks, a Bench led by Justice Vikram Nath said there was no occasion before the tribunal “to be swayed only on the per se ground that the hair-cut would be about 94.25% and that it was not convinced that the fair value of the assets have been projected in proper manner as the bid was very close to the fair value of the assets of Acil.” The apex court said “it is well within the Committee of Creditor’s domain as to how to deal with the entire debt of the corporate debtor.” If after repeated negotiations, a resolution plan had been approved by the CoC with a majority vote of 88.56%, such commercial wisdom was not required to be called into question or casually interfered with, it added. Lenders had voted in favour of Ramkrishna Forgings' taking over Acil at Rs 129.75 crore, translating into a 94% haircut to the Rs 1,762 crore of dues from the company.

Lux Industries jumped over 10% on Tuesday to the day's high of Rs 1,530 on the NSE following the Indian market regulator's decision to revoke the securities market ban imposed by it on 14 entities on account of alleged insider trading in the company. In a 10-page order by the Securities and Exchange Board of India (SEBI), the regulator said that the charges levelled against them could not be sustained. The 14 entities include Udit Todi, the son of the managing director of Lux, who is currently holding the post of executive director in the company, according to Sebi's order. In January 2022, SEBI, through its interim order had barred 14 entities from indulging in insider trading and ordered impounding ill-gotten gains of Rs 2.94 crore in the matter.
