RTE quota: HC junks Maharashtra govt notification giving conditional exemption to private schools
Bombay High Court on Friday quashed the Maharashtra government's notification that exempted private schools within a one-kilometre radius of government or aided schools from Right to Education (RTE) Act quota admissions. A division bench of Chief Justice D K Upadhyaya and Justice Amit Borkar said the notification dated February 9 was «ultra vires» to Article 21 of the Constitution of India and provisions of the Right of Children to Free and Compulsory Education Act, 2009, also known as the RTE. «The notification is held to be null and void,» the court said. The court, in its judgment, said the mandate of the law casts a duty not only on the government but also on private unaided schools to provide education to children in the age group of six to 14 years from the disadvantaged section of society.

Federal appeals court blocks remainder of Biden's student debt relief plan
Biden administration's student debt relief plan, which would have lowered monthly payments for millions of borrowers. In a ruling Thursday, the 8th Circuit Court of Appeals granted a motion for an administrative stay filed by a group of Republican-led states seeking to invalidate the administration's entire student loan forgiveness program. The court's order prohibits the administration from implementing the parts of the SAVE plan that were not already blocked by lower court rulings. The ruling comes the same day that the Biden administration announced another round of student loan forgiveness, this time totaling $1.2 billion in forgiveness for roughly 35,000 borrowers who are eligible for the Public Service Loan Forgiveness program.

Courts must not conduct intricate evidentiary enquiry on whether insurance claims raised by a party are time-barred or not, says SC
Supreme Court on Thursday held that the courts deciding an application for appointment of an arbitrator must not conduct an intricate evidentiary enquiry on whether the insurance claims raised by a party are time-barred or not. This, it said, should be left for determination by the arbitrator itself. Dismissing SBI General Insurance Co's appeal against the Gujarat High Court’s order that appointed an arbitrator to decide the dispute over insurance claims raised by Krish Spinning, a bench led by Chief Justice DY Chandrachud said “the effect of the aforesaid clarification is only to streamline the position of law, so as to bring it in conformity with the evolving principles of modern-day arbitration, and further to avoid the possibility of any conflict between the two decisions that may arise in future. It said the dispute raised by Krish being one of quantum and not of liability, prima facie, felt within the scope of the arbitration agreement and the dispute regarding 'accord and satisfaction' as raised by the insurance company can be decided by the arbitral tribunal as a preliminary issue.
