US judge blocks expulsion of Indian researcher detained over alleged Hamas ties
Hamas ties. The detention of Badar Khan Suri, a postdoctoral fellow at Georgetown University in the US capital, came as fears mount in the academic world that freedom of research and speech is being challenged two months into US President Donald Trump's new term. Suri's lawyer demanded his release and denounced the arrest as a «targeted, retaliatory detention» that was intended «to silence, or at the very least restrict and chill, his speech» as well as that of others who «express support for Palestinian rights.» Early Thursday evening Judge Patricia Tolliver Giles of the Eastern District of Virginia Court ordered Suri «shall not be removed from the United States unless and until the court issues a contrary order.» The American Civil Liberties Union (ACLU), which has also filed an emergency motion to stop the deportation, said Suri was being held at an immigration detention center in Louisiana.

Washington-based U.S. District Judge James Boasberg has given the administration until noon (1600 GMT) to either provide specifics on when the deportation flights took off and landed so he can determine whether they violated his order, or to invoke a legal doctrine involving state secrets to avoid sharing those details and explain their reasons for doing so. Boasberg gave the Justice Department the option of giving him the flight details under seal, meaning they would not be made public. But the judge expressed skepticism that the state secrets doctrine — which protects sensitive national security information from being disclosed in civil litigation — was applicable, given that U.S. Secretary of State Marco Rubio posted details of the flights on social media.

Efforts on to settle issue of recovery of mining royalty, tax dues with certain states: Centre to SC
tax dues on mineral rights and mineral-bearing lands between it and several mineral-rich states. The top court meanwhile deferred to April 24 the hearing on subsequent pleas of several mineral-rich states like Jharkhand seeking to recover royalty and tax dues on mineral rights and mineral-bearing lands worth thousands of crore of rupees from the Centre and the mining firms. A special three-judge bench comprising Justices Abhay S Oka and MM Sundresh and Ujjal Bhuyan said it will decide on the sequence in which the pleas of several mineral-rich states would be heard. Solicitor General Tushar Mehta, appearing for the Centre, said efforts were on to find a settlement of the issue and the pleas may be listed in the first week of May.

Allahabad High Court ruled that grabbing a minor girl’s breasts, breaking her pyjama strings, and trying to drag her beneath the culvert is not enough to charge an accused with the offence of rape or an attempt to rape. It described such an act as 'aggravated sexual assault’, TOI reported. Making this observation, the high court modified a summoning order, altering the charges against two accused. The accused were earlier summoned to face trail under section 376 (rape) and under the POCSO Act. However, now the accused will be tried under the section 354(B) IPC (assault or use of criminal force with intent to disrobe) and POCSO Act (aggravated sexual assault). «The allegations levelled against the accused Pawan and Akash and the facts of the case hardly constitute an offence of attempt to rape in the case. In order to bring out a charge of attempt to rape the prosecution must establish that it had gone beyond the stage of preparation. The difference between preparation and actual attempt to commit an offence consists chiefly in the greater degree of determination,” a bench of Justice Ram Manohar Narayan Mishra observed, as it partly allowed the criminal revision plea filed by the three accused. As per the prosecution, the accused Pawan and Akash grabbed the breasts of the 11-year-old victim and one of them broke the string of her pyjama and tried to drag her beneath the culvert.

Maintenance law meant to promote equality among spouses, not idleness: Delhi HC
Delhi High Court has held. The high court said qualified wives, having an earning capacity but desirous of remaining idle, should not set up a claim for interim maintenance. «Section 125 (order for maintenance of wives, children and parents) of the CrPC carries the legislative intent to maintain equality among the spouses, provide protection to the wives, children and parents, and not promote idleness» Justice Chandra Dhari Singh said in an order on Wednesday. The court passed the order while dismissing a woman's plea challenging a trial court's order denying her interim maintenance from her estranged husband. The court, however, encouraged the woman to actively look for a job to become self-sufficient as she already got wide exposure and is aware of the worldly affairs unlike other women who are not educated and completely dependent upon their spouses for basic sustenance. The couple got married in December 2019 and left for Singapore. It was alleged by the woman that owing to the cruelties done to her by her husband and his family, she returned to India in February 2021.

Sushant Singh Rajput's father, KK Singh on Thursday supported the Public Interest Litigation (PIL) filed by Disha Salian's father seeking a probe into his daughter's death, as he expressed hope that a conclusion could be reached on both the incidents. «I don't know his reasons and motivation for moving the court, but what he has done is right and if through this we can get a conclusion on whether it was a suicide or murder, and in this Sushant's case can also be known on what happened,» KK Singh told ANI. Earlier on March 19, Disha Salian's father had filed a petition in the Bombay High Court, seeking a probe into his daughter's death and called for interrogating UBT Sena leader Aaditya Thackeray. Talking to further, Singh said he is not aware of the reasons Salian's father moved the court, as earlier the latter had also agreed the death was by suicide. «Before (Disha) Salian's father had said he doesn't know anything, it is suicide only, but after that how and what he researched to say it is not a suicide but a murder, that I do not know. If it is true or not how can I say?» Sushant Singh Rajput's father added.

ED to file fresh charge sheet against Lalu Prasad, kin in land-for-jobs case
Enforcement Directorate (ED) will soon file a supplementary prosecution complaint (equivalent of a charge sheet) against former Union railways minister Lalu Prasad, Rabri Devi and their kin for their alleged involvement in the land-for-jobs case, said people in the know. The federal agency quizzed Lalu at its Patna office on Wednesday. Lalu's wife Rabri Devi, former chief minister of Bihar and their son Tej Pratap Yadav were questioned by the ED on Tuesday. According to agency sources, after filing the supplementary prosecution complaint, ED will push for commencement of trial against Lalu and co-accused in the case. «This will be the last prosecution complaint following which we would argue on framing of charges against the accused so that the trial can be kickstarted. This is one of the top priority cases for the agency,» said a senior official. According to agency sources, Lalu, Rabri and Tej Pratap were again summoned by the agency to confront them with the supplementary charge sheet recently filed by the CBI. In its latest charge sheet, the CBI had referred to five more parcels of land allegedly usurped by Lalu and his kin in lieu of jobs given to railway employees. Following CBI's recent revelations, the ED also quizzed Lalu and his kin pertaining to the five land parcels, said people in the know. But Lalu and his kin have denied the accusations levelled against them.

Nagpur violence: Eight VHP and Bajrang Dal activists surrender, released on bail

The accused have been identified as Amol Thakre, Mantri, VHP, Nagpur city; Lakhan Kuril, Goraksha Pramukh, Vidarbha Prant; Mukesh Barapatre, President of Central Nagpur, VHP; Rishabh Arkhel, Co-convenor of Bajrang Dal, Vidarbha; Shubham Arkhel, Co-convenor of Bajrang Dal, Nagpur City; Sushil Chaurasiya, VHP worker; Ramacharan Dubey, and Kamal Haryani, Convenor of Bajrang Dal, Nagpur City. They were booked by Kotwali Police for hurting religious sentiments by organising a protest in Napur city on Monday for the removal of Mughal emperor Aurangzeb's tomb, situated in Chhatrapati Sambhajinagar district. A case of hurting religious sentiments was also registered at Ganeshpeth police station against Govind Shende, VHP's secretary in-charge of Maharashtra and Goa and others. He is not arrested yet. The eight accused surrendered at Kotwali police station in the afternoon, following which police produced them in the court, the officer said.

The American Federation of Teachers in a lawsuit filed in federal court in Washington late Monday took aim at the Education Department's decision last month to halt borrowers' ability to enroll in the affordable repayment plans. The department made the change after a federal appeals court ruled that Democratic President Joe Biden's administration lacked authority to pursue a student debt relief program designed to lower monthly payments for millions of borrowers and speed up loan forgiveness for some. The court's decision, issued after Biden left office, had set back his administration's efforts to address what his White House described as a broken student debt system that can financially burden Americans seeking higher education. The Biden-era Saving on a Valuable Education (SAVE) Plan provided more generous terms than past income-based repayment plans, with monthly payments dropping for some borrowers to as low as $0. It also provided debt forgiveness for some smaller loans in as few as 10 years.

Justice Department lawyers said in a court filing that Washington-based U.S. District Judge James Boasberg was improperly intruding on presidential discretion to handle sensitive diplomatic and national security matters. Boasberg has issued an order temporarily banning the administration from removing migrants from the United States under the 18th century law that Trump invoked in proceeding with the deportations. Trump invoked the law, the Alien Enemies Act of 1798, to declare that the Venezuelan prison gang Tren de Aragua was conducting irregular warfare against the United States, subjecting its alleged members to deportation without a final order from an immigration judge, as generally required. «The pending questions are grave encroachments on core aspects of absolute and unreviewable Executive Branch authority,» the Justice Department lawyers wrote. The filing on Wednesday came a day after U.S. Chief Justice John Roberts rebuked Trump for calling for the judge's impeachment.

A senior police official said that they will fly out on Wednesday. Bombay High Court directed the Family Court to hear their case on Thursday, considering Chahal’s participation in the Indian Premier League (IPL), which begins on March 22, as reported by Bar and Bench. Chahal and Dhanashree have been living separately for over 2.5 years. Given this, they have requested the court to waive the mandatory six-month cooling-off period and grant them a divorce immediately. Under Section 13B of the Hindu Marriage Act, estranged couples must attempt reconciliation during this period before proceeding with divorce. However, a 2017 Supreme Court ruling allows for this period to be waived if both parties mutually agree. Earlier, on February 20, the Family Court denied their request for an early divorce due to partial alimony payments. Chahal had agreed to pay Dhanashree Rs 4.75 crore as alimony but had only transferred Rs 2.37 crore at the time of the hearing. The court noted that he had only partially fulfilled the settlement terms.

The primary contention in the Family Court ruling was the partial compliance with the consent terms, particularly regarding alimony. As per the agreement, Chahal had agreed to pay a permanent alimony of Rs 4.75 crore to Verma, of which Rs 2.37 crore had already been paid, Bar & Bench reported. The Family Court viewed the non-payment of the remaining amount as non-compliance, leading to the rejection of the waiver plea.
