The lurch back to South Korea's dark days of military rule only lasted a few hours, and after a night of protests and high drama last week Yoon was forced into a U-turn. But polls show a huge majority of citizens want him out and lawmakers voted Saturday to impeach him. He is now the third South Korean president to be impeached by parliamentary vote, and if upheld by the Constitutional Court would be the second to be removed from office.

Police Commissioner B. Dayananda assured, “A case has been registered already, and two teams have been formed. The investigation is ongoing, and we will ensure justice is delivered.”

Bombay HC clears 51-year-old man; states, 'medical evidence is not enough in sexual assault cases'
Nagpur Bench of the Bombay High Court recently overturned a 20-year rigorous imprisonment sentence handed down to a man convicted of sexually assaulting a 10-year-old girl. The court ruled that the conviction was based primarily on medical evidence, which the judges deemed insufficient without additional corroborative testimony. In its decision, the court emphasised that while medical findings can support a case, they cannot be the primary evidence in establishing guilt. The case dates back to January 2022, when the victim, a 10-year-old girl, visited her uncle’s house in Nagpur. The accused, a 51-year-old landlord, allegedly lured the child to a secluded area and sexually assaulted her. Following the incident, a medical examination confirmed physical injuries consistent with sexual assault. The victim's mother promptly filed a complaint, leading to the arrest of the accused. In June 2023, the special Pocso court convicted the man under Section 376-AB of the Indian Penal Code (IPC) and the relevant sections of the Protection of Children from Sexual Offences (Pocso) Act, relying heavily on the medical findings and the victim's statement recorded under Section 164 of the Code of Criminal Procedure. The court sentenced the accused to 20 years in prison.

ED restitutes assets worth Rs 4025 cr to JSW
JSW, which was a Successful Resolution Applicant to the assets of erstwhile Bhushan Power and Steel Ltd under the Insolvency and Bankruptcy Code (IBC) corporate resolution process (CIRP), the agency said on Saturday. The assets were initially provisionally attached by the ED under Section 5 of the Prevention of Money Laundering Act (PMLA). The attachment was made after investigations revealed that the former promoters of Bhushan Power and Steel Ltd had defrauded banks and diverted funds for private investments. The restitution was made under the second proviso to Section 8(8) of PMLA (restitution pending trial) read with Rule 3A of PMLA Restoration of Property Rules, with the approval of the Supreme Court on December 11 this year.

Switzerland scraps MFN clause in tax treaty with India
Double Tax Avoidance Agreement (DTAA) with India effective January 1, 2025, in a move that may raise the tax outgo on dividend income for Indian entities operating in the European country. The decision follows India’s Supreme Court ruling in October 2023 in a case involving Swiss multinational Nestle SA. The court had held that the MFN clause under the DTAA does not get automatically triggered until notified under the Income Tax Act, 1961. “On the basis of the Indian Supreme Court ruling, the Swiss competent authority acknowledges that its interpretation of para 5 of the Protocol to the IN-CH DTA is not shared by the Indian side,” said a recent statement issued by the Swiss authorities. “In the absence of reciprocity, it therefore waives its unilateral application with effect from 1 January 2025.”
