NCLAT reserves order in Jaiprakash Associates' appeal
NCLAT), on Monday, reserved its order in Jaiprakash Associates Ltd's (JAL) appeal against NCLT's order of admitting it into insolvency. National Company Law Tribunal (NCLT) Allahabad passed an insolvency admission order earlier this year on ICICI bank's plea, holding the construction and infrastructure company to have defaulted on payments amounting to ₹1269 crore. JAL has argued that its total debt was restructured under the master restructuring agreement (MRA), and the default date mentioned by the lenders goes before the MRA, which is bad in law.

A bench comprising Chief Justice of India (CJI) D Y Chandrachud and Justices J B Pardiwala and Manoj Misra on October 22 reserved the judgement on eight petitions, including the lead one filed by Anjum Kadari, against the high court verdict. On March 22, the Allahabad High Court had declared the Act as «unconstitutional» and violative of the principle of secularism, and asked the state government to accommodate madrasa students in the formal schooling system.

Supreme Court on Monday said it would consider the the mercy petition of death row convict Balwant Singh Rajoana, convicted in the 1995 assassination case of then Punjab chief minister Beant Singh, if the Centre does not decide on it «either way». A bench of Justices B R Gavai, P K Mishra and K V Viswanathan adjourned for two weeks the former Punjab Police constable's plea seeking commutation of his death sentence to life term due to an «inordinate delay» in deciding his mercy petition. «Decide it either way or we will consider it (Rajoana's plea),» the bench told Solicitor General Tushar Mehta, appearing for the Centre, after he informed the court that Rajoana's mercy plea was pending with the president's house. Rajoana has been in continuous custody for 29 years, said his counsel, senior advocate Mukul Rohatgi, while seeking his release till the mercy petition is decided.

The Enforcement Directorate (ED) issued a statement on Saturday, saying it filed a prosecution complaint before a special Prevention of Money Laundering Act (PMLA) court in Bengaluru last month against eight accused who allegedly «lured» common people through «fake» IPO allotments and stock market investments through fraudulent apps. «Probe found that a huge network of cyber scams in India, involving fake stock market investments and digital arrest schemes executed primarily through social media platforms like Facebook, Instagram, WhatsApp, and Telegram. »Known as 'pig-butchering' scams, stock market investment scams entice victims with promises of high returns, using fake websites and misleading WhatsApp groups that appear connected to reputable financial firms," the Enforcement Directorate said.

PepsiCo won the dismissal of New York's lawsuit accusing the beverage and snack-food company of polluting the environment with single-use plastic packaging, as the judge criticized the state's attorney general, Letitia James, for bringing the case. bankruptcy judge approved a sale of Tupperware Brands on Tuesday, paving the way for the iconic food storage company to soon exit Chapter 11 protection and continue offering its products while undergoing a hoped-for revitalization. The sale given the court's green light in Delaware still is subject to closing conditions. Under terms of the deal, a group of lenders is buying Tupperware's brand name and various operating assets for $23.5 million in cash and more than $63 million in debt relief. Tupperware agreed to the lender takeover last week, pivoting from a previously planned asset auction. The brand said it expects to operate as The New Tupperware Co. upon completion of the deal.
