Age-gating rules apply to all firms under data law
data law's mandate of verifying the age of minors through parental consent has sent scores of companies from telcos, banks, to ecommerce companies and their lawyers in a tizzy. Not just social media platforms, but all companies will need to have age verification mechanisms, otherwise, there's no way to record the verifiable consent of users, experts told ET. The mandate will be high cost and time consuming, which is worrying all firms, they added.

Angel Tax: No assessment of startups registered with DPIIT
Central Board of Direct Taxes (CBDT) has clarified to the field formations that assessing officers will not pick up cases for scrutiny for startups registered with the Department for Promotion of Industry and Internal Trades (DPIIT) if the cases are related to the valuation of angel tax. This means startups registered by the DPIIT Start-ups will not face tax verification on account of angel taxation in case they are picked up for scrutiny. There are 99,380 startups recognised by the DPIIT. Besides, in cases where proceedings are auto generated, «contentions of such recognised startup companies on the issues will be summarily accepted». However they may be subject to verification for other taxation issues. The clarification came after a large number of startups received notices related to angel tax valuation during April and May, including those registered with the DPIIT. DPPIT-recognised startups are exempted from section 56 (2) (viib) of the IT Act, which determines angel tax.

NEW DELHI : Mauritius-based offshore funds facing ambiguity over capital gains tax have received a shot in the arm at last following a verdict of the Mumbai bench of the Income Tax Appellate Tribunal (ITAT). In a case about the foreign direct investment of Indium IV Holdings (Mauritius), the tribunal has allowed the fund to carry forward long term capital loss (LTCL) while simultaneously allowing the fund to claim treaty benefit for short term capital gains (STCG).

Rs 10,000 crore-erosion! FPI sell-off continues in October. What's in store for rest of the month
foreign investors continued through the month of October as they pulled out about Rs 10,000 crore so far. As per NSDL data, FPIs sold equity for Rs 13,652 crore through the stock exchanges till October 13, but invested Rs 3,868 crore through the primary market, making them net sellers in the month so far. Sustained rise in US bond yields in anticipation of further rates and uncertain geopolitical environment have been the main contributing factors for FII offloading Indian shares. The selling was seen in financials, power, and IT, but they continued to buy capital goods and automobiles. In September, FPIs net sold shares worth a whopping Rs 30,000 crore in eight sectors, while investments worth over Rs 1,000 crore were made only in four sectors. Overall, the total investment by FPIs in equity has reached Rs 1.1 lakh crore and over Rs 33,000 crore in the debt market this year so far. Analysts said the Indian market continues to exhibit resilience even amid many challenges and that investors may turn optimistic in the near future. «India, with its strong macro fundamentals, seems to be a place where people want to continue to stay invested. So, we believe that the pace of selling of the FPIs, especially in banks, is coming off,» said Unmesh Sharma of HDFC Securities. «There is a growing concern among FPIs, that if they continue to sell, they will miss out on the potential rally in the Indian market.

FPIs take out Rs 9,800 cr in Oct on rise in US bond yields, geopolitical uncertainties
Foreign investors have pulled out nearly Rs 9,800 crore from Indian equities this month so far owing to a sustained rise in US bond yields and the uncertain environment resulting from the Israel-Hamas conflict. This came after Foreign Portfolio Investors (FPIs) turned net sellers in September and pulled out Rs 14,767 crore. Before the outflow, FPIs were incessantly buying Indian equities in the last six months from March to August and brought in Rs 1.74 lakh crore during the period.
