Supreme Court judge P K Mishra on Friday recused himself from hearing the bail plea of former Delhi minister Satyendar Jain in a money laundering case. The Enforcement Directorate (ED) had arrested Jain on May 30 last year on the charge of laundering money through four companies allegedly linked to him. As the matter came before the bench headed by Justice A S Bopanna, he told senior advocate Abhishek Singhvi, appearing for Jain, that it would not be able to take up the matter. «We are unable to take it up before this bench,» Justice Bopanna said. The bench directed that the matter be placed before Chief Justice D Y Chandrachud to get appropriate orders for reassignment to a bench. «Obtain orders from the Chief Justice to place it before a bench of which one of us (Justice Mishra) is not a part,» Justice Bopanna said.

FIVE voice hearing Bilkis Bano case: SC to resume hearing on Aug 31 on batch of pleas challenging remission to convicts
Supreme Court is scheduled to resume hearing on Thursday a clutch of petitions challenging the remission granted to all 11 convicts in the Bilkis Bano gang-rape case and murder of seven of her family members during the 2002 Gujarat riots. A bench of Justices BV Nagarathna and Ujjal Bhuyan, which is hearing the final arguments on the pleas challenging the remission granted to the convicts, will hear for the seventh day the submissions of the accused who are defending their release. While hearing the arguments on August 24, the top court had said, «Law is supposed to be a noble profession,» as it voiced surprise over how can one of the convicts in the case practice law after his conviction, the remission of his sentence notwithstanding. The issue came to the court's notice when advocate Rishi Malhotra, defending the remission granted to Radheshyam Shah, told the bench that his client had served over 15 years of actual sentence and the state government gave him the relief after taking note of his conduct. The Gujarat government had released all 11 convicts in the case on the basis of the 1992 remission policy and not the policy adopted in 2014, which is now in force. Under the 2014 policy, the state cannot grant remission for a crime investigated by the CBI or where people have been convicted of murder with rape or gang-rape. Besides the petition filed by Bilkis Bano, contesting the remission granted to them, several other PILs including one by CPI(M) leader Subhashini Ali, independent journalist Revati Laul and former vice-chancellor of Lucknow University Roop Rekha Verma have challenged the remission.

Allahabad High Court on Monday fixed September 12 as the next date of hearing in the Gyanvapi mosque-Kashi Vishwanath temple dispute. A single bench had last month reserved its verdict for pronouncement on Monday, August 28, but on Friday last week, the matter was suddenly transferred for hearing by the bench of chief justice of the high court, a development that the Anjuman Intezamia Mosque Committee questioned. Verdict on five matters, including a challenge to the maintainability of the 1991 suit which claimed that the Gyanvapi mosque was built on the structure of the old Shiva temple and sought the declaration of the mosque as part of the temple as well as a challenge to the 2021 order of a Varanasi court directing the Archaeological Survey of India to conduct a comprehensive survey of the mosque was to be delivered on Monday. The single judge bench of Justice Prakash Padia had, after months of hearing, fixed August 28 as the date of delivery of his verdict on the pleas.
