Ahead of SC order on Arvind Kejriwal's interim bail plea, ED likely to file supplementary chargesheet in court
Enforcement Directorate is likely to file a chargesheet against Delhi Chief Minister Arvind Kejriwal on Friday, the day when the top court is expected to announce its verdict in the bail case, as per media reports. Earlier, the Supreme Court pushed forward the verdict on Delhi chief minister Arvind Kejriwal's interim bail plea and said that it may announce the order on Thursday or next week, without specifying the date. The SC raised concerns regarding the Enforcement Directorate's (ED) prolonged investigation into the excise policy-linked money laundering case involving Kejriwal. The SC bench comprising Justices Sanjiv Khanna and Dipankar Datta told Arvind Kejriwal's counsel Abhishek Singhvi that if it were to give interim bail to the Aam Aadmi Party's national convenor, it doesn’t want him to be performing official duties as the CM as it could lead to a conflict somewhere.

SC asks Centre to not use "threat and coercion" in GST recovery operations
Supreme Court on Wednesday instructed the Centre to refrain from employing "threat and coercion" tactics during search and seizure operations aimed at recovering Goods and Services Tax (GST) from traders. The bench, comprising Justices Sanjiv Khanna, MM Sundresh, and Bela M Trivedi, who are reviewing different sections of the GST Act, emphasised that the law does not grant authorities the power to use force to collect outstanding dues. «There is no power under the Act to compel any person to pay the tax liability during the search and seizures. Request your department to ensure that the payment is made voluntarily without any use of force. A period of three to four days must be provided to the accused individual to seek advice, contemplate, and settle the liability. It should be voluntary and there should not be use of any threat or coercion,» the bench told Additional Solicitor General SV Raju, appearing for the Centre. Raju did not rule out the possibility of using force in the past but mentioned that usually the payment during search and seizure is voluntary.

A man has admitted in court that he killed four women in Winnipeg, but his lawyers are asking he be found not criminally responsible because of mental illness.Court of King’s Bench Chief Justice Glenn Joyal said Monday the question of Jeremy Skibicki’s mental capacity and intent will now be the focus of the trial.The Crown agreed the trial, which was supposed to be with a jury, will instead be heard by a judge alone because of complexities with this type of defence.“Concluding this matter before a jury does pose some challenges,” said prosecutor Christian Vanderhooft.The trial is to start Wednesday.Skibicki, 37, has pleaded not guilty to four counts of first-degree murder.His lawyers argued last week for the case to be heard in front of a judge alone. They said a jury trial would infringe on Skibicki’s rights to a fair trial because of significant pretrial publicity.The lawyers also expressed concerns a jury would have negative views of Skibicki using a not criminally responsible defence.

New MSME payment clause in I-T Act: Supreme Court tells traders to move HC
Supreme Court on Monday refused to entertain a petition by traders’ associations, challenging the constitutionality of Section 43B(H) of the Income Tax Act that requires businesses to settle their dues with micro, small and medium enterprises (MSMEs) within 45 days to claim tax benefits. A bench led by Chief Justice DY Chandrachud instead asked the petitioners – Federation of All India Vyapar Mandal, Federation of Madras Merchants and Manufacturers Association, and Confederation of West Bengal Trade Associations – to move the high court for any relief. The new rule has come into force from April 1.
