Delhi court refuses to summon Arvind Kejriwal in defamation case by BJP leader
Delhi court on Tuesday refused to summon Chief Minister Arvind Kejriwal in a criminal complaint filed by a BJP leader who accused him of defamation for claiming that AAP leaders were approached to join the saffron party in return for cash. Additional Chief Metropolitan Magistrate Tanya Bamniyal, however, summoned AAP leader Atishi, saying «prima facie» there was sufficient evidence against her in the matter. The judge directed Atishi, a minister in the Kejriwal cabinet, to appear before the court on June 29. BJP leader Praveen Shankar Kapoor had filed a case against Kejriwal and Atishi over poaching allegations made by the two.

Rouse Avenue Court on Tuesday summoned Aam Aadmi Party (AAP) leader Atishi Marlena in a defamation suit filed by Bharatiya Janata Party (BJP) leader Praveen Shankar Kapoor. The court has asked the Delhi Minister to appear before it on June 29 in a suit which alleged that Delhi CM Arvind Kejriwal and Atishi have accused the saffron party of attempting to lure AAP MLAS and bribe them to switch parties are unfounded and defamatory. The court has, however, refused to summon Arvind Kejriwal.

It is appropriate if they consult seniors like us. Without consulting if they both decide on their own, it is not right according to me. Those with seniority and experience, both in the party and the government and having contacts, should be consulted. They have to discuss with us,» Parameshwara said.

Four European Union banks seek RBI nod for clearing model
European banks, which also play key custodian roles in the local sovereign debt trade, have sought the Reserve Bank of India's (RBI) go-ahead for a third-party transaction model to break the impasse involving their home authorities and domestic policymakers over audit oversight rights. «There was a meeting last month between the heads of four European banks and top RBI officials. The banks have sought the RBI's approval on the proposed third-party model because there is no established rulebook for this kind of arrangement,» a source aware of the developments said. After the meeting, attended by RBI deputy governor T Rabi Sankar, the overseas lenders concerned expect the central bank to communicate its views within the next few weeks, another source said.

HC offers relief to Pidilite in Dr Fixit dispute for now
High Court has restrained Dubond Products India from manufacturing, distributing or selling its waterproofing product that allegedly has identical trade mark/dressing of Dr Fixit until further order. Mumbai-based Pidilite Industries, the maker of Fevicol and M-Seal adhesive brands, has approached the court to restrain Dubond Products from allegedly infringing its registered trademarks, copyright and passing off for its waterproofing brand Dr Fixit LW. Passing off in intellectual property rights (IPR) law means making a false representation that is likely to induce a person to believe that the goods or services are those of another. «The balance of convenience is overwhelmingly in favour of the plaintiff (Pidilite). Further, irreparable harm and loss will be caused to the plaintiff due to the defendant's continued use of the marks which are wrongful activities,» observed Justice RI Chagla in its order of May 21. «The defendant has various other products apart from the impugned product and therefore the defendant's business will not be affected upon the grant of injunction,» he said further in a 81-page order.
