Karnataka High Court on Wednesday accepted a memo filed by the State Government withdrawing its consent to the CBI to probe Deputy CM DK Shivakumar in a disproportionate assets (DA) case. The court also allowed Shivakumar to withdraw his appeal challenging the investigation, citing the withdrawal of consent to the central agency.
A division bench of Chief Justice PB Varale and Justice Krishna S Dixit said it cannot comment on the state's decision to withdraw consent to the CBI in the absence of any legal challenge to the government notification, issued on Tuesday, following last week's Cabinet decision.
The CBI counsel, however, informed the bench that the notification was aimed at protecting the interests of Shivakumar.
Senior advocate AM Singhvi, appearing for Shivakumar, submitted that the case was liable to be disposed of, as the matter (sanction) had become infructuous after the government notifying withdrawal of sanction to prosecute Shivakumar. Someone may, later, challenge it or may not, and it was not the concern of the court, at this stage.
