Delhi High Court on Thursday issued showcause notice to Go First resolution professional (RP) Shailendra Ajmera as to why contempt proceedings should not be initiated against him for non-compliance of its orders.
Several lessors of the bankrupt airline had alleged that the RP had failed to conduct any maintenance on their aircraft leased to the airline and had wilfully defied the HC orders.
Justice Tata Vitasta Ganju also asked the lessors to work out the modalities for a solution in this regard. However, the HC clarified that it was not directing anyone's presence at the moment. She noted that from the RP's previous affidavits showed that maintenance had not been carried out by the airline's officer.
Lessors argued that there are court orders that need to be honoured and the longer the hearing drags on, the greater is the responsibility of the RP to maintain the aircraft. The RP also failed to schedule the monthly inspections despite persistent follow-ups, they added.
Lessors led by DAE (SY 22) 13 Ireland Designated Activity Co had in November moved a contempt petition alleging «wilful and deliberate violation» of the HC's October 12 order that asked the RP of the grounded carrier to give various details/records of their aircraft within 14 days. Besides, the HC had in July also asked the RP to continue to maintain their aircraft and allow the lessors to carry out periodic monthly inspections.
