Reactions to CCI's preliminary probe reports are premature. It's crucial to understand that CCI's investigation reports are only preliminary findings, based on an investigation conducted by DG.
These reports are not CCI's final decision, nor binding on anyone. DG's investigation is one step in a lengthy quasi-judicial process that will culminate in a final decision by CCI. One needs to contextualise DG's investigation within CCI's overall decision-making process.
CCI follows a five-step process to determine competition law infringement.
Step 1 A formal CCI investigation is triggered by a complaint or 'information' received. In the Amazon/Flipkart case, the informant was the Delhi Vyapar Mahasangh, and in the Swiggy/Zomato case, the investigation was triggered by a complaint from the National Restaurant Association of India (NRAI).
