Spouse with earning capacity can't be permitted to sit idle and saddle partner with expenses responsibility: HC
Delhi High Court has observed that a spouse who has a reasonable capacity to earn but chooses to remain unemployed and idle without sufficient explanation should not be permitted to saddle the other partner with the one-sided responsibility of meeting expenses by providing maintenance. The high court made the observation while reducing the amount of monthly maintenance from Rs 30,000 to Rs 21,000 to be paid by a man to his estranged wife under the Hindu Marriage Act (HMA). It said the woman claimed to have no independent source of income but has a reasonable educational background being a graduate from Delhi University. “She appears to have voluntarily undertaken social work as claimed despite there being no impediment to undertaking meaningful employment. «The spouse having a reasonable capacity of earning but who chooses to remain unemployed and idle without any sufficient explanation or indicating sincere efforts to gain employment should not be permitted to saddle the other party with one-sided responsibility of meeting out the expenses,” a bench of justices V Kameswar Rao and Anoop Kumar Mendiratta said. The bench said the maintenance does not have to be provided with mathematical precision but to give relief to the spouse who is unable to maintain and support during the pendency of proceedings and to ensure that the party should not suffer due to paucity of source of income. It said the provision for maintenance under the HMA is gender neutral and sections 24 and 25 of the Act provide for the rights, liabilities and obligations arising from marriage between the parties. "Haryana CM should stop doing politics," says Punjab Minister as blame game continues over stubble burning

Divergence of opinions by different HCs: SC admits IBBI petition
Supreme Court on Tuesday allowed the Insolvency and Bankruptcy Board of India (IBBI) petition and transferred to the Bombay High Court various petitions pending before the high courts of Delhi and Madhya Pradesh. This was done after the IBBI pleaded that such transfer either to the apex court or to any of the HCs was necessary to avoid multiplicity of proceedings and confusion caused by possible divergence of opinions by different HCs. The three petitions pending before the HCs of Bombay, Delhi and Madhya Pradesh have challenged the vires of the Regulation 31 A of the Insolvency and Bankruptcy Board of India (Insolvency Resolution process for Corporate Persons) Regulations, 2016 by questioning the powers of the board to issue sub-ordinate legislation. The Fifth amendment to the CIRP Regulations, which was notified on September 20, 2022 and came into force from October 10, last year, had inserted the provision relating to the payment of regulatory fees to IBBI under the Regulation 31(ba) read with Regulation 31A of the CIRP Regulation.

Delhi High Court has in its recent ruling clarified that the extended 10-year review period for Income-Tax (I-T) assessments should only be applied when the assessee's alleged undisclosed income exceeds ₹50 lakh, The Times of India reported.
