In setback for lenders, Supreme Court dismisses pleas over govt dues under IBC
State Bank of India and Indian Overseas Bank, seeking recovery of their dues, the Supreme Court on Tuesday dismissed their petitions seeking a review of its earlier judgement that statutory creditors like tax authorities and government agencies would be considered secured creditors under the Insolvency and Bankruptcy Code (IBC). A Bench comprising justices Justices AS Bopanna and Bela M Trivedi while affirming its last year’s view said it had considered the waterfall mechanism and the other provisions of the Code before arriving at its decision for deciding the priority for distribution of sale proceeds of assets, etc. The case does not “fall under the ambit of review,” it said. On September 6 last year, the top court ruled that any insolvency resolution plan, approved by the financial creditors by ignoring the statutory demands payable to state and Central governments or other legal authorities, was liable to be rejected.

Bharatiya Janata Party on Sunday released the first list of 52 candidates for the Telangana Assembly elections, set to be held on November 30. Members of Parliament Soyam Bapu Rao, Arvind Dharmapuri and Bandi Sanjay Kumar have been fielded from Boath, Koratla and Karimnagar, respectively, while MLA T Raja Singh is set to contest from Goshamahal. Of the 52 candidates, 12 are women, while 14 candidates are from Scheduled Caste/Scheduled Tribe backgrounds. Earlier today, the national party revoked the suspension of Singh, who was suspended by the party in August 2022 for his purported remarks against the Prophet in a video posted on social media. “The central disciplinary committee of the BJP revoked the suspension of Shri T Raja Singh MLA Gosha Mahal from the BJP after due consideration of his explanation in response to the show cause notice served by the party,” a party statement said. Other notable candidates include Eatala Rajender — a former Telangana Rashtra Samithi leader — who is contesting from Huzurabad and Gajwel, where he will go up against current Chief Minister K Chandrasekhar Rao.

Enforcement Directorate's (ED) powers to arrest and attach property involved in money laundering under PMLA required any reconsideration. NEW DELHI : The Supreme Court on Tuesday refused to grant legal recognition to same-sex couples and said only Parliament and state legislatures can validate marital unions in a ruling that disappointed millions of lesbian, gay, bisexual, transgender and queer (LGBTQ+) people in India. By a 3-2 majority, the court also declined to grant constitutional protection to civil unions and adoption rights for queer couples, noting that mandating the state to grant recognition or legal status to some unions will violate the doctrine of separation of powers and could lead to unforeseeable consequences.
