May consider interim bail to Arvind Kejriwal due to Lok Sabha polls: SC
Supreme Court on Friday verbally observed that it could consider granting interim bail to Delhi chief minister Arvind Kejriwal due to the Lok Sabha elections. A bench of justices Sanjiv Khanna and Dipankar Datta made the oral observation after observing that the arguments on Kejriwal's plea, challenging his arrest in the Delhi excise scandal, may take time to conclude. The bench enquired about the date of polling in Delhi. «This may take time. But if the case takes time, we may consider the question of interim bail due to elections,» justice Khanna remarked orally. However he made it clear, repeatedly that the bench has not decided anything in this regard and was merely posing a query to the ED counsel to be answered on Tuesday.

Why no bail plea in trial court, SC asks Delhi CM Arvind Kejriwal
Supreme Court on Monday asked Delhi Chief Minister Arvind Kejriwal, who has been arrested in a money-laundering case stemming from the alleged excise policy scam, why has he not filed a bail application before the trial court. A bench of Justices Sanjiv Khanna and Dipankar Datta was hearing the Aam Aadmi Party (AAP) leader's plea challenging his arrest by the Enforcement Directorate (ED). «You did not move any application for bail before the trial court?» the bench asked senior advocate Abhishek Singhvi, who appeared in the court on behalf of Kejriwal.

SC to hear Arvind Kejriwal's plea against arrest in money laundering case on April 29
Supreme Court is scheduled to hear on Monday a plea by Delhi Chief Minister Arvind Kejriwal challenging his arrest in a money laundering case stemming from the alleged excise policy scam. A bench of Justices Sanjiv Khanna and Dipankar Datta is likely to hear the matter. Kejriwal had earlier told the apex court that his «illegal arrest» in the case constitutes an unprecedented assault on the tenets of democracy based on «free and fair elections» and «federalism». In a rejoinder to the Enforcement Directorate's (ED) reply affidavit filed on his petition challenging his arrest in the case, Kejriwal said the mode, manner and timing of his arrest just before the Lok Sabha elections when the Model Code of Conduct had come into play, speaks volumes about the «arbitrariness» of the agency.

Introduced nearly 11 years ago to enhance transparency, VVPATs back in focus after SC verdict
Supreme Court's decision on Friday rejecting pleas seeking complete cross-verification of votes cast using EVMs with a Voter Verifiable Paper Audit Trail (VVPAT) has brought the focus back on the paper trail machines. To enhance transparency and verifiability in the poll process, the Conduct of Election Rules, 1961 were amended in 2013 to introduce the use of VVPAT machines. They were first used in the by-election to the Noksen assembly seat in Nagaland. At least one ballot unit, one control unit and one VVPAT make up for an EVM. The tentative cost of an EVM comprised Rs 7,900 per ballot unit, Rs 9,800 per control unit and Rs 16,000 per VVPAT.

Husband has no control over wife's 'stridhan,' rules Supreme Court
husband has no control over his wife's 'stridhan' (woman's property) and while he may use it during the time of his distress, he has a moral obligation to return it to his wife, the Supreme Court has reiterated while directing a man to pay Rs 25 lakh to a woman in return for her lost gold. The woman in this case claimed that 89 sovereigns of gold were gifted to her by her family at the time of marriage. Additionally, after the wedding, her father gave a cheque for Rs 2 lakh to her husband. According to the woman, on the first night of their marriage, the husband took custody of all her jewellery and entrusted the same to his mother under the garb of safekeeping. She alleged that all the jewellery was misappropriated by the husband and his mother to discharge their pre-existing financial liabilities. The Family Court, in 2011, held that the husband and his mother had indeed misappropriated the appellant's gold jewellery and that she was entitled to recoup the loss caused to her by the said misappropriation.

EVM source code should never be disclosed: SC
Supreme Court on Wednesday made it clear that EVM source codes «should never be disclosed» as the same can be misused. A bench comprising justices Sanjiv Khanna and Dipankar Datta made the verbal observation during the resumed hearing of a batch of pleas seeking directions to tally voter-verifiable paper audit trail (VVPAT) slips with votes cast through EVMs during elections. Justice Datta questioned the counsel for one of the petitioners as to whether SC can issue directions regarding electronic voting machines (EVMs) «merely on the basis of suspicion» of hacking and manipulating though there is no concrete proof to prove the same. The petitioner raised doubts about whether EVMs are hack proof. The bench assembled on Wednesday to seek a slew of clarifications from the Election Commission of India on the technical functioning of EVMs, flash memory, VVPATs etc.

Time for greed over but still betting on 6 metal & specialty chemical stocks: Sanjiv Bhasin
Sanjiv Bhasin, Director, IIFL Securities, says in October, when the FII short position was over 74%, that was when one had to be greedy. Now they have turned long on 18% and there is no short position. So, now, one should be fearful. You have to take it at your own risk reward. I see no risk reward right now till the earnings season is over as a large part of the positives of earnings are already priced in.” Bhasin says: “I continue to be positive on a buy on Vedanta on any decline and a buy on Nalco and SAIL. In specialty chemicals, UPL, Navin, Aarti are looking good.” You had earlier warned that this month could get a little volatile and looking at the CPI and the PPI print in the US and the way the markets panned out from there, it seems like we got to brace ourselves for a little bit of global volatility? Sanjiv Bhasin: That is very much on the cards. However, like you see in the US, the Magnificent Seven are again touted to have their best week in the last three. So, weak data or hotter than expected inflation is all getting absorbed. It is typical of a bull market which is ignoring bad news just on the pretext that people are feeling missed out.
