Hear out, show proof to borrowers suspected of 'wilful default': Bombay HC
High Court ruling directing commercial banks to produce evidence to defaulting customers before invoking the master circular on wilful default will bring respite to small borrowers arm-twisted into settling loans, but it may also encourage large borrowers to go to courts and delay recovery, said industry experts. This landmark order delivered by the high court last week and the banking regulator's directive to banks that the defaulter be given an in-person hearing will significantly change the way banks tag borrowers as wilful, they added. A division bench comprising justices BP Colabawalla and Somasekhar Sundaresan issued the order in a case involving IL&FS director Milind Patel versus Union Bank of India.

Courts can't stop people from engaging in political activities as condition of bail: Supreme Court
Supreme Court has quashed the bail condition imposed by the Orissa High Court on a man that he shall not be involved in any political activity, saying it will breach his fundamental rights. A bench of Justices B R Gavai and Sandeep Mehta passed the order on a plea filed by Siba Shankar Das, a former Mayor of Berhampur Municipal Corporation, against the January 18 order of the high court. The high court had dismissed his application seeking withdrawal of the bail condition which said that he «shall not create any untoward situation in public and shall not be involved in any political activities, directly or indirectly». The condition was imposed by the high court while ordering his release on bail in August 2022.

Congress accuses ruling CPI(M) in Kerala of using CAA for electoral gains
Congress on Tuesday accused the ruling CPI(M) in Kerala of using the CAA for electoral gains, and said it is trying to alienate Muslim voters from the Congress on the «lie» that the grand old party did not oppose the controversial law Separately, Congress leaders asserted that if the INDIA front, of which the Left parties are a part, comes to power, the legislation will be «thrown in the dustbin». Congress Working Committee member and MP from Thiruvananthapuram Shashi Tharoor said that the Left front in Kerala is spreading «lies» and «distorting» the facts about the grand old party's role in opposing the Citizenship (Amendment) Act (CAA), right from its introduction as a bill in Parliament. Tharoor said that the Communist party, «which contributed minimally» to the freedom struggle during its crucial years, is today «trying to reap its benefits for political points in the most disgracefully dishonest way». Similarly, Leader of Opposition in the state assembly V D Satheesan accused Chief Minister Pinarayi Vijayan of misusing the CAA for political gains. Satheesan said that Wayanad Congress MP Rahul Gandhi and various other UDF MPs have spoken against the CAA, details of which have been forwarded to Vijayan. Despite that, the CM is lying and misusing the citizenship law to attract votes from the minorities, especially Muslims, the opposition leader alleged.

PIL in Delhi HC seeks direction to restrain Kejriwal from issuing any order while in custody
PIL) has been moved in the Delhi High Court, praying for a direction to restrain Chief Minister Arvind Kejriwal from issuing orders while in police custody of the Directorate of Enforcement (ED). Plea also seeks direction not to provide a typist, computer printer, etc. to Arvind Kejriwal while he is in the police custody of ED. Also, to direct the ED to register a complaint, investigate and prosecute Arvind Kejriwal as to how the directions or order issued by him while in police custody reached the possession of Delhi Minister Atishi. There is a likelihood that the order issued by Kejriwal in the capacity of Chief Minister of the NCT of Delhi may influence a fair and proper investigation. A fair and proper investigation is always conducive to the ends of justice and to establishing the rule of law.

A $20 Billion Deal Depends on Whether You Think Walmart Is a Supermarket
Where you go to buy a loaf of bread or a bunch of bananas could help determine the fate of the biggest-ever supermarket merger deal. In Greeley, Colo., shoppers can head to King Soopers in the center of town, owned by supermarket giant Kroger—or they can try a Safeway, owned by rival grocery-store operator Albertsons, about 2 miles away. On the northeast side is a Walmart that sells groceries, and it also has a Sprouts Farmers Market, as well as about a dozen dollar stores within 7 miles of town.

SpiceJet settles Rs 755 crore liabilities of lessor
SpiceJet on Tuesday said it has agreed to a pact with Export Development Canada (EDC) to settle liabilities worth Rs 755 crore. The settlement will generate savings to the tune of Rs 567 crore, the airline said in a statement. As part of the agreement, SpiceJet will also acquire ownership of 13 EDC-financed Q400 aircraft. Twelve out of these 13 aircraft were grounded as the airline had failed to pay lease rentals to the lessor. SpiceJet chairman Ajay Singh said the settlement will allow the airline to strengthen its balance sheet. «This settlement not only alleviates SpiceJet of a substantial financial burden but also lays the groundwork for a fortified balance sheet and substantial savings for the airline,» said the airline.
