CJI Sanjiv Khanna recuses himself from hearing pleas related to felling of trees in Delhi ridge
Delhi Ridge area. Earlier, a bench headed by the then CJI D Y Chandrachud, since retired, had sought a personal affidavit of Delhi Lieutenant Governor V K Saxena in the case which had also sought initiation of contempt proceedings against certain DDA officials. At the outset, the CJI, who was sitting on the bench with Justice Sanjay Kumar, said, «One thing I would like to point out that when I was the NALSA chairman, I had gone to Patna and with Delhi LG had toured jails there. So, it will not be appropriate for me to hear the plea...». The bench ordered the listing of the pleas before a bench of which the CJI is not part in the week commencing November 27.

RG Kar: Police blow vehicle horn outside court to prevent reporters from hearing accused's voice
Kolkata Police on Monday brought R G Kar Medical College and Hospital rape-murder accused Sanjay Roy to Sealdah court in an apparent attempt to prevent journalists from hearing his voice. Roy had made certain remarks against former Kolkata police commissioner Vineet Goyal and claimed his innocence when he was being taken out of the prison van before being produced before Sealdah court on November 11, the opening day of the trial. To prevent Roy from speaking during Monday's appearance, police constantly honked the vehicle's horn and slapped its body as he was escorted to the court building, eyewitnesses said. Police also replaced the van with a smaller one to transport Roy to avoid further disruptions from Tuesday last.

Supreme Court on Monday junked a petition seeking an inquiry into the death of Netaji Subhash Chandra Bose. A bench comprising Justice Surya Kant and Justice Ujjal Bhuyan dismissed the public interest litigation, saying the top court is not a remedy for everything. «It's not the court's job to run the government,» the bench said. The apex court had earlier come down heavily on the petitioner, saying the plea contains «reckless and irresponsible allegations» against leaders who are no longer alive.

SC to hear plea seeking enforcement of measures to curb pollution in Delhi
Supreme Court is scheduled to hear on Monday a plea seeking enforcement of measures to curb air pollution in the national capital. Delhi woke up to toxic air conditions on Sunday as the Air Quality Index (AQI) was recorded in the «severe» category. The AQI stood at 429 at 9 am, according to the 'Sameer App', which provides hourly updates from the Central Pollution Control Board (CPCB). The 24-hour average AQI was recorded at 417 at 4 pm on Saturday. As per the cause list of November 18 uploaded on the apex court website, a bench of Justices Abhay S Oka and Augustine George Masih is slated to hear the plea.

Foreign companies need Union govt nod to do surveys in India: Kerala HC

The ruling from the High Court came while disposing of a plea seeking quashing of criminal proceedings against an Indian company for conducting a survey in Thiruvananthapuram in 2010, which according to the police was aimed at «injuring the emotional feelings of the Muslim community». The survey was conducted by the Indian company — Taylor Nelson Sofres (TNS) PLC-- for US-based Princeton Survey Research Associates (PSRA). Rejecting the Indian company's plea to quash the criminal proceedings against it, Justice P V Kunhikrishnan said that if such surveys were allowed to continue, they «will affect the security of our country and importantly religious harmony». «The central government should take it very seriously, and if there is any intention to topple the integrity of our country by conducting such surveys, appropriate steps should be taken in accordance with the law,» the High Court said in its order of November 4. It also noted that in the instant matter, there was no sanction from the central government for conducting such a survey.

money laundering case linked to alleged duping of plot buyers, noting that the Enforcement Directorate (ED) arrested him in a «brazen manner» in «disregard» of Delhi High Court orders, adding that the approach needed to be «deprecated». Special Judge Gaurav Gupta granted relief to Rajesh Katyal, who was accused of duping innocent plot buyers of their hard-earned money. The judge noted the submissions made by senior advocates Vikas Pahwa and Geeta Luthra, appearing for the accused, that Delhi High Court directed status quo in the FIR, based on which the ED lodged its case, by an order passed on July 30, 2024. «Since FIR forms part of the predicate offence (based on which the ED lodged the present case), the ED ought to have abided by the said order. However, in a brazen manner and in disregard of orders passed by a Constitutional court, the ED proceeded to arrest the accused.
