Man forcing wife to leave her job is cruelty, says MP HC; allows woman's divorce plea
Madhya Pradesh High Court said while allowing a woman's divorce plea. The 33-year-old woman works as a manager with a Central government undertaking. She moved the HC after the Family Court dismissed her divorce plea, which claimed her husband was mentally harassing her to leave her job and live with him in Bhopal. In its order of November 13, a division bench of MP High Court comprising Chief Justice Suresh Kumar Kait and Justice Sushrut Arvind Dharmadhikari overturned the family court's decision and allowed the woman's plea for divorce. «Whether husband or wife wants to live together, it is their wish. Neither husband nor wife can force the other side not to do a job or do any job as per the choice of the spouse. In the present case, the husband compelled his wife to leave the government job till he gets a job. In this manner, forcing the wife to leave her job and live as per his wish and style amounts to cruelty,» the bench said.

Supreme Court seeking its nod to bring on record various news reports and additional documents to highlight dilapidated conditions of bridges in Bihar. A bench comprising the then Chief Justice D Y Chandrachud, since retired, and Justices J B Pardiwala and Manoj Misra had on July 29 this year sought responses from the Bihar government and others, including the National Highway Authorities of India (NHAI), on the PIL filed by lawyer Brajesh Singh. On November 4, the top court agreed to consider listing for hearing the PIL that raised concerns about the safety and longevity of bridges in Bihar after several of them collapsed in recent months. The plea is likely to be heard on November 18.

SC directs Centre to respond on rehabilitation framework for victims of sex trafficking
Supreme Court has said there is a legislative vacuum with regard to the establishment of a comprehensive rehabilitation framework for victims of sex trafficking. The top court directed the Centre to consider the issue and file an affidavit regarding it. «Human and sex trafficking are crimes that dehumanises the victim and violates the victim's right to life, freedom and personal security. Vulnerable sections of society, especially women and children, are disproportionately affected in such crimes,» said a bench of Justices J B Pardiwala and Pankaj Mithal. The apex court said the victims of such crimes are often mistreated by their traffickers and have to endure physical and mental forms of violence that are inflicted upon them.

Delhi HC refuses to interfere with arbitral award in favour of Jindal Saw
Delhi High Court has refused to interfere with an arbitral award, which directed GAIL to pay over USD 7 million to Jindal Saw Ltd. On October 29, a bench of Justices Visbhu Bakhru and Sachin Datta dismissed GAIL's appeal against a single judge's decision upholding the award, saying that it was «unmerited». The dispute in the matter pertained to delayed delivery of pipes by SAW Pipes Ltd, now Jindal Saw Ltd, to Gas Authority of India Ltd (GAIL). The Arbitral Tribunal, passed in December 2002 and then amended in March 2003, had held that GAIL was responsible for the delay by not taking the delivery of the goods and therefore allowed the claims filed by SAW Pipes Ltd.
