BCCI seeks withdrawal of insolvency petition against Byju's in NCLAT
BCCI) Tuesday sought withdrawal of its insolvency petition against embattled edtech firm Byju's in the National Company Law Tribunal (NCLT). The move by the cricket control board follows a Supreme Court of India ruling on October 23, which quashed a National Company Law Appellate Tribunal (NCLAT) order allowing a settlement between BCCI and Byju's. On August 2, NCLAT’s Chennai bench approved Byju’s founders’ settlement of the Rs 158 crore payment owed to BCCI, helping the edtech company avoid bankruptcy. The matter will be heard on November 18.

Meanwhile, the sole accused Sanjay Roy, while leaving the court in the evening, claimed today that he has been falsely implicated by Kolkata Police. The trial is being conducted on a fast-track and daily basis. «I have been a victim of conspiracy. Vineet Goyal and DC Special have falsely implicated me,» Roy said today from the prison van. Recently, Roy has claimed in front of media channels, while he was being produced in court, that he did not commit rape or murder, and he was being falsely implicated by the police. Pointing at the Kolkata Police, where he worked as a civic volunteer, Roy also claimed he had been threatened by his own departmental colleagues to remain silent in the matter.

Kolkata rape and murder: SC stays Cal HC order directing CBI probe into custodial torture case
Supreme Court on Monday stayed a Calcutta High Court's order directing a CBI probe into the alleged torture of a woman in police custody after her arrest over protests against the rape and murder of a doctor of R G Kar Medical College and Hospital. A bench of Justices Surya Kant and Ujjal Bhuyan asked the West Bengal government to submit a list of seven IPS officers, including five women, who could be included in a fresh Special Investigation Team (SIT) for probing the custodial torture case. The order was passed on an appeal filed by the West Bengal government which had stated the high court had erroneously passed the order directing a CBI probe and the state police was capable of the investigation. On November 6, a division bench of the Calcutta High Court upheld an order of a single judge directing a CBI investigation into the allegations levelled by the woman.

Donald Trump's resounding election victory, a Manhattan judge is poised to decide whether to uphold the hush money verdict or dismiss it because of a U.S. Supreme Court decision in July that gave presidents broad immunity from criminal prosecution, as per a report. Judge Juan M Merchan has said he will issue a written opinion Tuesday on Trump's request to toss his conviction and either order a new trial or dismiss the indictment entirely, AP reported. Merchan had been expected to rule in September, but put it off «to avoid any appearance» he was trying to sway the election. His decision could be on ice again if Trump takes other steps to delay or end the case.

SC dismisses Sebi's appeals against SAT relief for Reliance, promoters
Supreme Court on Monday dismissed the Securities and Exchange Board of India's appeals against a Securities Appellate Tribunal’s (SAT) July order that set aside the market regulator's penalty of Rs 25 crore imposed on Reliance Industries (RIL), its promoters Mukesh Ambani and Anil Ambani and others in April 2021 for violating takeover norms in a case related to the acquisition of RIL shares between 1994-2000. The apex court also dismissed another Sebi appeal against SAT’s December 4 order that set aside the Rs 25-crore penalty imposed by the market regulator on RIL, Rs 15 crore on Mukesh Ambani, Rs 20 crore on Navi Mumbai SEZ and Rs 10 crore on Mumbai SEZ for their alleged role in the manipulation of prices of Reliance Petroleum Ltd (RPL)s shares in November 2007. While the appellate tribunal had quashed the penalties against Mukesh Ambani, Navi Mumbai SEZ, and Mumbai SEZ in the same case, it upheld SEBI's penalty against Reliance Industries. RPL was absorbed into RIL in 2009.

Chandrachud retires on November 10, he will leave with one of the most significant legacies in the history of the Supreme Court. There has never been a CJI as prolific as Chandrachud in terms of judicial output. He has written 92 judgments as CJI, more than his last 4 predecessors put together. To put things in perspective, the last CJI who served a similar 2-year term, SH Kapadia authored 27 judgments, less than a third of Chandrachud. “This is a testament to how incredibly hard-working Chandrachud has been as CJI,” wrote Anrghya Sengupta Research Director, Vidhi Centre for Legal Policy, for TOI.
