SC dismisses plea against anti-defection law
Supreme Court on Friday dismissed a plea against the anti-defection law (Tenth Schedule) of the Constitution. The law brought in 1985 by the 52nd constitutional amendment deals with situations of defection in Parliament or state legislatures by members of a political party, independent members and nominated members, and lays the grounds for disqualification of the members. Members of Parliament or Legislative Assembly are disqualified if they are found to have defected from their original party on whose ticket they were elected.

Bombay HC strikes down amended IT Rules; terms them unconstitutional
Bombay High Court on Friday held as unconstitutional and struck down the amended Information Technology (IT) Rules which sought to identify fake and false content on social media against the government. The matter was assigned to Justice A S Chandurkar as 'tie-breaker judge', after a division bench in January delivered a split verdict on the petitions challenging the amended IT rules. Justice Chandurkar on Friday held that the rules violated constitutional provisions. «I have considered the matter extensively. The impugned rules are violative of Article 14 (right to equality), 19 (freedom of speech and expression) and 19(1)(g) (freedom and right to profession) of the Constitution of India,» the judge said.

Coaching centre deaths: SC asks Centre-appointed panel to submit interim measures in 4 weeks
Supreme Court on Friday directed a Union government-appointed high-level committee probing the death of three IAS aspirants in a coaching centre here in July due to flooding in the building's basement to submit interim measures in four weeks to prevent such incidents. A bench of Justices Surya Kant and Ujjal Bhuyan directed the Haryana, Uttar Pradesh and Delhi governments to apprise the court of policy, legislative and administrative changes made to prevent a repeat of such incidents. It said uniform initiatives should be taken in the entire National Capital Region to prevent another Old Rajendra Nagar-type incident from happening. «If the need arises, we will pass directions for pan-India to prevent Old Rajendra Nagar-type incidents,» the bench observed.

Bombay HC grants temporary relief to CEAT in case against Apollo Tyres’ ads
Bombay High Court has directed Apollo Tyres Ltd. to stop circulating advertisements that allegedly disparage CEAT Ltd’s car tyre variant ‘Crossdrive AT’ until further order, granting temporary relief to the RPG group-owned listed tyre company. In a recent order, the court said that CEAT has made out a strong prima facie case for the grant of ad-interim relief in its petition, alleging that some advertisements for Apollo Tyres’ variant ‘Apterra AT2’ shared through YouTube, Instagram, X, LinkedIn and Facebook portray ‘Crossdrive AT’ in a negative light. “The balance of convenience is in favour of the plaintiff (CEAT Ltd),” Justice RI Chagla observed in his 16-page interim order. “Unless reliefs as prayed for are granted, the Plaintiff will suffer irreparable harm/injury which cannot be compensated in terms of money.”

Karnataka new traffic rule: Get ready to pay Rs 1,000 traffic fine if you don't have this
Karnataka who do not have High-Security Registration Plates (HSRP) on their vehicles will soon face penalties ranging from Rs 500 to Rs 1,000. Transport Minister Ramalinga Reddy said that enforcement of this rule will begin in early October, around 15 days from now. HSRP numbers have been installed in just 53 lakh vehicles out of the over 2 crore older vehicles in the state. The Karnataka Transport Department issued a notification in August 2023, making HSRP mandatory for vehicles registered before April 1, 2019. Initially, a three-month deadline was set, but due to a lack of response from vehicle owners and other factors like the Lok Sabha elections, the deadline was extended multiple times. The issue also reached the Karnataka High Court, and the last deadline was set for September 15. «While adjourning the case for hearing recently, the HC did not give any direction on further extending the deadline for the installation of HSRP. Instead of immediately imposing a penalty, the department would give 15 days' time for the motorists to follow the rule; thereafter, the enforcement activities will start (in early October),» said Minister Reddy.

Madrassa degrees only valid for jobs requiring class 12 qualifications: UP govt tells Supreme Court
Uttar Pradesh government told Supreme Court that the madrassa education system, focusing on religious studies, is out of sync with mainstream education and that students studying in the theological establishments could be employed only in jobs requiring class 10 or 12 pass qualifications, reported TOI. UP government's affidavit was filed in a clutch of appeals by madrassas and their teachers challenging Allahabad HC's judgment, which on March 22 quashed the Madrasa Education Act, 2004, terming it violative of fundamental rights and the principle of secularism. SC has since stayed the HC judgment. The state said mainstream subjects are taught in madrassas till class 8 as per State Council of Educational Research and Training syllabus, and, " In class 9 and 10, mainstream subjects are not compulsory… students have to choose only one subject from mathematics, home science (only for girls), logic and philosophy, social science, science and Tib (traditional medical science)."

Is a state law hiking levy binding on central govt?
Punjab and the Centre in the Supreme Court, which raises a broader issue: whether state legislation that raises fees for foodgrain procurement under central PDS schemes is binding on the Union government. Punjab raised the levy to 6% of the minimum support price (MSP) for all foodgrains procured from the state, while the Centre agreed to reimburse only 2% of this levy, a standard rate applied across all states, to cover procurement costs. This state levy, reimbursed by Centre to states, is over and above the cost of foodgrains it pays to states. These foodgrains are distributed free or at subsidised prices to weaker and vulnerable sections of society under the Pradhan Mantri Garib Kalyan Anna Yojana, Antyodaya and Targeted Public Distribution System.

SC seeks info from govt on non-appointment of judges despite Collegium's reiteration
Supreme Court on Friday asked the Centre to provide information about the numbers and names reiterated by the apex court Collegium for appointment as judges in higher judiciary with reasons why they were not considered so far and at what level they were pending. The direction was passed by a bench headed by Chief Justice D Y Chandrachud while hearing a PIL seeking a direction that a time limit be fixed for the Centre to notify the appointment of judges recommended by the Supreme Court Collegium. «The Supreme Court Collegium is not a search committee (for judges) whose recommendations can be stalled,» said the bench which also comprised Justices J B Pardiwala and Manoj Misra. The bench asked Attorney General (AG) R Venkataramani, appearing for the Centre, to provide it with a list of names reiterated by the Collegium and say «why they are pending and at what level».

Trapped in bureaucracy: The ordeal of recovering unclaimed shares in India
For Ashita Awasthy, the journey to reclaim her father's long-forgotten shares has been a gruelling odyssey. Bought in the 1990s and discovered in 2015, the shares—some jointly held with her and others in her mother's name—had languished for decades, a silent testament to the bureaucratic labyrinth that plagues India's Investor Education and Protection Fund (IEPF), often ensnaring unsuspecting investors.

India’s AI strides run into privacy law headwinds
Many companies are building proprietary GenAI models without enough transparency about the use of personal data being processed for training purposes, experts said, adding that this could go against the principles of lawful consent, fairness and transparency as prescribed in the Digital Personal Data Protection (DPDP) Act. The legislation, passed by Parliament in August last year, provides for the protection of the personal data of individuals while allowing the processing of such data for lawful purposes. With privacy being a fundamental right, companies are worried about legal liabilities that could arise over non-compliance, said experts.

SC ruling won't impact talks with lenders, vendors: Vi
Kolkata: Vodafone Idea's (Vi) talks with lenders and vendors are on track and the failure of the curative petition in the Supreme Court on the adjusted gross revenue (AGR) issue would not affect those because the case was not factored into the company's business plan or discussions, people familiar with the matter said. A person familiar with the matter said the curative petition was not factored into any business plan given to the lenders. Even the techno-economic assessment that the lenders have done is favourable and does not talk about the curative ruling at all. «We are in active discussions with multiple banks. A key milestone in this process was the updating of the independent techno-economic evaluation initiated by the banks, which was completed recently,» a Vodafone Idea (Vi) spokesperson said in response to ET's queries.
