A bench of Justices B V Nagarathna and Ujjal Bhuyan had on October 12 last year reserved its verdict after an 11-day hearing on the petitions, including the one filed by Bano.

MUMBAI : The National Company Law Appellate Tribunal has dismissed an appeal by non-bank financier Authum Investment and Infrastructure challenging a bankruptcy tribunal order that had rejected its objections to a resolution plan for two Srei companies. The National Company Law Tribunal had in August approved a resolution plan submitted by National Asset Reconstruction Co. Ltd (NARCL) for Srei Infrastructure Finance Ltd (SIFL) and Srei Equipment Finance Ltd (SEFL).

A Division bench comprising justice Suresh Kumar Kait and Neena Bansal Krishna noted that Adani Power’s submissions that the department (revenue) has filed a review in the SC. “Accordingly, till then, direction given in paragraph 52 (directing the CBI to look into over invoicing allegations) shall not be applicable in case of Adani Power,” it said. A review petition filed by the Revenue department against dismissal of its appeal last year is pending before the apex court.

Ministry of Defence lost a decade-long legal battle on the deficient supply of kidney beans or rajma to the Kendriya Bhandar (KB), with the Army Purchase Organisation being directed by the arbitrator to return the cashed bank guarantee amount of Rs 44.5 lakh to KB with 7.5 per cent interest since 2012, a TOI report stated. The Supreme Court, led by Chief Justice of India DY Chandrachud, informed the Attorney General R Venkataramani, who represented the Ministry of Defence, that there were no grounds to challenge the findings of the trial court and the Delhi High Court, which had upheld the arbitral award. In May 2011, the Army Purchase Organisation (APO) had invited tenders for the supply of 1,200 tonnes of rajma for defence services, estimated at a cost of Rs 4.44 crore. KB was awarded the contract and provided a bank guarantee of Rs 44.5 lakh as a security deposit. A dispute arose over the quality of rajma supplied by KB.
