Marital rape: Will decide constitutional validity of laws granting immunity to husbands, says SC
Supreme Court on Thursday said it will decide the constitutional validity of penal provisions in the Indian Penal Code (IPC) and the Bharatiya Nyaya Sanhita (BNS) which grant immunity from prosecution to a husband for the offence of rape if he forces his wife, who is not a minor, to have sex with him. A bench of Chief Justice of India D Y Chandrachud and Justices J B Pardiwala and Manoj Misra sought views of the petitioners on Centre's contention that making such acts punishable would severely impact the conjugal relationship and cause serious disturbances in the institution of marriage. Senior advocate Karuna Nundy, appearing for one of the petitioners, opened the arguments and referred to the provisions of the IPC and BNS on marital rape. «It is a constitutional question. There are two judgments before us and we have to decide. The core issue is of the constitutional validity (of the penal provisions),» the CJI said.

She further emphasized that the incident took place many years ago, when Khan was younger, and urged the community to forgive him. She said, “Even today, I do make mistakes; you also make mistakes. We'll keep making mistakes till we are alive, it's human nature. This is innately built within us and nobody is perfect. But if you're attempting to kill someone or firing bullets on him then you're crossing the line. I don't support hunting as a sport but this event took place so many years ago. Salman was much younger in 1998. I want to request the head of the Bishnoi tribe to forget about it and move on. I apologise on his behalf (Salman) if he has made a mistake and please forgive him.”

Supreme Court on Tuesday said mere existence of a benchmark disability of 40 percent does not bar a person from pursuing medical education unless there is an expert report that the candidate was incapacitated from pursuing MBBS. A bench of Justices BR Gavai, Aravind Kumar and KV Viswanathan gave detailed reasons for its September 18 order where it allowed a candidate to take admission in MBBS course after the medical board opined that he can pursue medical education without any impediment. The bench said the capacity of a candidate suffering from disability to pursue the MBBS course has to be examined by the disability assessment board. It said, «Mere existence of benchmark disability will not disqualify a candidate from being eligible for the MBBS course. The disability board assessing the disability of the candidate must positively record whether the disability of the candidate will or will not come in the way of the candidate pursuing the course.»
