FIVE WhatsApp Justice prevention Courts Kavitha gets bail in Delhi excise case
Supreme Court Tuesday granted bail to Bharat Rashtra Samithi (BRS) leader K Kavitha, an accused in the alleged irregularities linked to the Delhi government's now-scrapped excise policy. «Investigation is complete and chargesheet has been filed. Custody of Kavitha is not necessary,» a division bench headed by Justice BR Gavai said. «The likelihood of trial being concluded in the near future is impossible. As said in various pronouncements of this court, undertrial custody should not turn into a punishment,» it ruled. The bench took exception to the Delhi High Court's observation that an educated, sophisticated woman is not entitled to bail under the beneficiary provision for women under the Prevention of Money Laundering Act. The high court had made the observation while turning down the bail plea of Kavitha, an ex-MP and daughter of former Telangana chief minister K Chandrashekhar Rao. The high court in July held that she was not a vulnerable person.

Provident WhatsApp wellness Justice Department Courts Supreme Court to see if Black Money Act can be used retrospectively
Supreme Court has agreed to look into the retrospective applicability of a provision in the Black Money (Undisclosed Foreign Income and Assets) Imposition of Tax Act, 2015, under which the revenue department can initiate criminal prosecution against businesspeople for violations that were allegedly committed much before the law came into force. A bench led by Justice Abhay S Oka, while issuing notices to various businessmen, stayed the Karnataka High Court's June judgment that held retrospective applicability of section 72 of the 2015 Act as unconstitutional. The apex court posted the matter for further hearing on September 20. On June 7, the high court had held that criminal prosecution initiated for acts done prior to the enactment of the law were not valid under Article 20 of the Constitution. The order was pronounced in the case of Dhanashree Ravindra Pandit.

composer band Justice Schools Courts Colleges Why MVA's Maharashtra Bandh over Badlapur sexual abuse cases was withdrawn at the last minute
Maha Vikas Aghadi (MVA), a coalition of the Congress, Shiv Sena (UBT), and Nationalist Congress Party (SP), has called off its planned bandh on August 24 in Maharashtra following the Bombay High Court's intervention. The MVA initially called the bandh in response to the alleged sexual abuse of two kindergarten girls in the Badlapur district. The High Court noted that enforcing the bandh would paralyze normal life and cited its 2004 order declaring such bandhs unconstitutional. The Bombay High Court bench, composed of Chief Justice DK Upadhyaya and Justice Amit Borkar, heard two petitions challenging the band call. In its ruling, the bench said that significant losses could occur if political parties proceeded with the bandh. The court stated, «Until further orders all concerned are restrained from proceeding with the call for bandh on August 24 and also on any other further date. We are, prima facie, convinced the call given by political parties is a call to observe bandh tomorrow in the entire state of Maharashtra, which means a call for cessation of all kinds of activities which will result in the life of the state coming to a halt, that may entail heavy loss to industrial activities, business activities, economic activities and other such activities.»

WhatsApp community Justice Investigations peace Tribal MLAs want panel to expedite probe into Manipur ethnic violence
separate administration or a Union Territory for tribals in Manipur, have urged the Centre to ask the judicial commission probing the ethnic violence in the state to expedite its probe. They demanded that chief minister N Biren Singh be «immediately barred» from the office so that he can't influence the «outcome» of the investigation. The MLAs, including two ministers, said: «We once again appeal to the Government of India to expedite our demand for a separate administration in the form of UT with a legislature, as that alone is the path to lasting peace in the region.» Last June, the MHA, had constituted a three-member Commission of Inquiry, headed by former chief justice Ajai Lamba, to probe ethnic violence in Manipur. The tribal legislators, seven of whom belong to the ruling BJP, in a joint statement said that the judicial commission must expedite its investigation and identify the guilty. The statement said that the state government had to issue a press release on August 7 regarding some «doctored audio clips», which claimed to be that of the CM and meant to incite communal violence and derail various peace initiatives by the state and central governments at multiple levels.
