Delhi HC issues contempt notice to Go First RP
Delhi High Court on Thursday issued showcause notice to Go First resolution professional (RP) Shailendra Ajmera as to why contempt proceedings should not be initiated against him for non-compliance of its orders. Several lessors of the bankrupt airline had alleged that the RP had failed to conduct any maintenance on their aircraft leased to the airline and had wilfully defied the HC orders. Justice Tata Vitasta Ganju also asked the lessors to work out the modalities for a solution in this regard. However, the HC clarified that it was not directing anyone's presence at the moment. She noted that from the RP's previous affidavits showed that maintenance had not been carried out by the airline's officer.

Jalan Kalrock Consortium case: SC upholds NCLAT ruling on sale of Jet Airways' three aircraft
Supreme Court on Thursday dismissed an appeal by the Jalan Kalrock Consortium (JKC), the successful bidder for takeover of grounded Jet Airways (India), seeking to halt sale of the airline's three aircraft to a Malta-based aviation company. A Bench led by Justice Abhay S Oka upheld the National Company Law Appellate Tribunal's December order that allowed the sale of the aircraft to Ace Aviation VII. The apex court also observed that the sale of aircraft to the aviation company would in fact help the consortium to revive the embattled airline. JKC had challenged the jurisdiction of the NCLT or the appellate tribunal to direct specific performance of the Letter of Intent, saying the LoI does not have a binding contractual value. It further argued that the NCLAT had failed to consider that it was being «prejudiced for the fault of a third party that has no locus to submit an application before the NCLT essentially seeking specific performance against the monitoring committee of the corporate debtor, having no privity to the resolution plan or its implementation.»

SC seeks Centre's response on PIL seeking palliative care as part of national health programme
Supreme Court sought the Centre's response on Thursday on a PIL seeking a direction to authorities to provide palliative care to terminally-ill persons as part of the national health programme. A bench comprising Chief Justice D Y Chandrachud and justices J B Pardiwala and Manoj Misra took note of the submissions made by senior advocate Jayna Kothari, who appeared in the court on behalf of the petitioner, that palliative care should be recognised and made part of the national health programme. The court did not agree to one of the prayers in the public interest litigation (PIL) matter filed by Bengaluru resident Rajshree Nagaraju that the right to get palliative care be declared as a part of right to health under Article 21 (protection of life and liberty) of the Constitution. «You seek mandamus (a writ) stating palliative care comes under Article 21. I do not think that you need to pursue this prayer. The right to palliative care is part of the right to health and life… Article 21 covers all aspects of human existence,» the CJI said.

CBI gets Sandeshkhali prime accused Shahjahan Sheikh's custody
CBI on Wednesday evening got the custody of suspended Trinamool Congress leader Shahjahan Sheikh from CID after a fresh directive by the Calcutta High Court. The court ordered CID to hand over Sheikh, the alleged prime accused in the attack on ED officials in Sandeshkhali on January 5, to CBI by 4:15 pm. However, Sheikh was reportedly taken by the CID team to the state-run hospital SSKM through the backdoor of Bhabani Bhawan (police headquarters), people in the know told ET. CID finally gave official custody of Sheikh to CBI at 7 pm.

Bengal Police hands over Sandeshkhali accused Shahjahan Sheikh to CBI after Calcutta HC order
The CBI got the custody of Sheikh Shahjahan on Wednesday. The Trinamool Congress leader, who is the prime accused in the Sandeshkhali ED official attack case, was handed over by state CID hours after a new order by the Calcutta High Court earlier in the day. After the medical examination, Shahjahan was handed over to CBI at the Bhabani Bhaban Police Headquarters. Earlier in the day, the Calcutta High Court stated that the investigation into the attack on ED officials should be transferred to the CBI, and the custody of the accused Sheikh Shahjahan should be arranged promptly.

Sanatana Dharma row: Madras HC calls Stalin Jr’s comments ‘divisive’
Madras High Court on Wednesday held Tamil Nadu Youth Welfare & Sports minister Udhayanidhi Stalin's comments on Sanatana Dharma as «divisive» and against the “Constitutional principles” while refusing to issue writ of quo warranto to remove him, his ministerial colleague Sekar Babu and DMK MP A Raja (Nilgiris) from their ministerial positions. Justice Anita Sumanth said persons holding Constitutional positions must not make divisive comments, and Stalin Jr's remarks equating Sanatana Dharma to HIV, AIDS, Malaria etc., were `perverse.' Such claims about Sanatana Dharma which were unverified in nature amounted to spreading misinformation, the Judge said, disposing of a petition from the Hindu Munnani, which took serious objection to Stalin Jr's comments, and questioned their continuation in office after making such remarks in public, while praying for a writ of quo warranto.

Pakistan prime minister Zulfikar Ali Bhutto, executed by the military regime in 1979, did not receive a fair trial, the Supreme Court observed on Wednesday. Chief Justice Qazi Faez Isa announced the unanimous opinion of a nine-member larger bench of the apex court during the hearing of a presidential reference related to the death sentence given to the Pakistan Peoples Party (PPP) founder. It is based on a special case sent in 2011 by then president Asif Ali Zardari to the Supreme Court to revisit his father-in-law Bhutto's conviction for abetment in a murder case and his eventual hanging in 1979.
