Reinsurance and coinsurance are not the supply of a service and, hence, not liable to tax, according to a decision by the Goods and Services Tax (GST) Council on Saturday. This spells a significant breather to insurance companies facing thousands of crores in tax demands. The GST Council also recommended clarifications on taxability of reimbursements of securities or shares as employee stock option plans given by a company to its workers. Officials said exemptions would be conditional and notified later. Coinsurance, in this instance, refers to insurers sharing insurance-bearing liabilities. Reinsurance is the cover an insurer buys to insure itself through the payment of premiums. The industry has contended that GST should only be paid by one company in this chain. However, the Directorate General of Goods and Services Tax Intelligence (DGGI) last year issued notices to about 20 insurance companies raising tax demands of about Rs 12,000 crore for non-payment of GST on coinsurance and reinsurance premiums. Apex grouping General Insurance Council had lobbied the government, seeking clarity. It submitted that the levy of GST on all firms amounted to double taxation.

GST taxpayers will now have the option to amend outward supply or sales return form GSTR-1 before payment of taxes for a month or quarter. The GST Council in its meeting on Saturday had recommended providing a new optional facility by way of Form GSTR-1A to facilitate taxpayers to amend the details in Form GSTR-1 for a tax period and/or to declare additional details. GSTR-1A will, however, have to be filed before filing of return in GSTR-3B for the said tax period. This will facilitate the taxpayer to add any particulars of supply of the current tax period missed out in reporting in form GSTR-1 of the said tax period or to amend any particulars already declared in GSTR-1 of the current tax period (including those declared in IFF, for the first and second months of a quarter, if any, for quarterly taxpayers), to ensure that correct liability is auto-populated in GSTR-3B.

The Ministry of Education on Saturday entrusted the matter of alleged irregularities in the NEET (UG) Examination 2024 to the Central Bureau of Investigation (CBI) for a comprehensive investigation. CBI has been handed charge by the Centre to probe irregularities in both UGC-NET and NEET-UG examinations. «National Testing Agency (NTA) conducted the NEET(UG) Examination on May 5, 2024 in OMR (Pen and paper) mode. Certain cases of alleged irregularities/cheating/impersonation/malpractices have been reported. For transparency on the conduct of the examination process, the Ministry of Education, Government of India, after a review has decided to entrust the matter to the Central Bureau of Investigation (CBI) for comprehensive investigation. Central Government has also enacted the Public Examination (Prevention of Unfair Means) Act, 2024, to prevent unfair means in public examinations and to provide for matter connected therewith or incidental thereto,» the government said.
