election-related materials, particularly electronic records such as CCTV footage.
On December 9, the Punjab and Haryana High Court invoked the 1961 rulebook to order the poll panel to submit videography, CCTV footage, and copies of papers relating to votes cast at a polling station during the recent Haryana assembly elections to counsel Mehmood Pracha.
The latest amendment in Rule 93(2)(a) of the Conduct of Election Rules, 1961 will allow EC to deny CCTV footage/electronic records.
The amendment made now, however, reads that «all other papers as specified in these rules relating to the election shall be open to public inspection.»
The rules only mention documents such as nomination forms, appointment of election agents, results and election account statements. However, recently information on other ECI measures — which are not specified in the 1961 Rules — such as CCTV camera footage, webcasting footage and video recording of candidates in model code period was also being sought citing Rule 93(2)(a).
