The determined landlord filed an eviction suit against the tenants on November 28, 2001, on the grounds of default in payment of rent, refusal to vacate and for personal need of the premises for establishing an ultrasound machine for his two unemployed sons.
The irony is that tenants were not convinced with the reason cited by the owner. The tenants questioned this idea of the landlord, and argued why his two unemployed sons need an ultrasound machine and what are their qualifications for running such a business. The tenants also questioned in court about why the landlord needs this particular house occupied by them when he already has two other houses.
Undeterred by the tactics adopted by tenants the owner kept fighting over a period of 24 years and ultimately got justice at the Supreme Court.
Interestingly the legal angle that his lawyer took for filing the appeal in Supreme Court was ‘bona fide’ reason for eviction. Read below to learn what is this ‘bona fide’ legal reasoning and other arguments used by the landlord’s lawyer that convinced the Supreme Court to allow the landlord’s appeal.
