Alec Baldwin and the production company of his film Rust were accused of negligent and reckless behavior on set on October 21, 2021, which led to the death of cinematographer Halyna Hutchins when she was shot at with a gun meant for filming purposes. Baldwin has been fighting the case since then.
Three former crew members on the sets of Rust – Ross Addiego, Doran Curtin, and Reese Price – have sued Baldwin, Rust Movie Productions, LLC, and El Dorado Pictures for compensatory and punitive damages for injuries they claim they suffered on set.
These are «including, but not limited to, hearing loss, temporary deafness, and vibrational shock.»
Now, the key gaffer on the film has filed a lawsuit against Alec Baldwin for the fatal shooting of Halyna Hutchins. A judge has denied a motion by the actor to dismiss the civil lawsuit in August 2023.
The judge had also denied a motion in August to stay civil action pending a resolution of criminal proceedings.
Now, Judge Bryan Biedscheid said that this could be re-examined as the case continues, as reported on Fox News.
Alec Baldwin lost his attempt in September 2023 to stay a lawsuit, as his legal team presented that the special prosecution is considering filing new charges against the actor. The actor’s lawyers said that the court adjourned the scheduling conference in the case until November 2023.
The plaintiffs have agreed not to serve discovery in the near future.
Alec Baldwin is permitted to refile the motion if circumstances change.
