Merely being not named in predicate offence doesn't mean one can't be prosecuted under PMLA: Supreme Court
predicate offence does not mean that he cannot be prosecuted under the Prevention of Money Laundering Act (PMLA), the Supreme Court said on Friday while hearing a plea in a money-laundering case arising out of the alleged coal-block allocation scam. The observation came from a vacation bench of Justices Bela M Trivedi and Pankaj Mithal, which was hearing a petition filed by one Sudhir Gupta seeking quashing of an Enforcement Case Information Report (ECIR) against him and the subsequent proceedings arising out of it. The bench told advocate Vijay Aggarwal, who appeared in the court on behalf of Gupta, that the Enforcement Directorate (ED) ECIR could neither be quashed nor stayed. Aggarwal told the bench that the petitioner was arrayed as a witness in a related case lodged by the Central Bureau of Investigation (CBI), but the ED has made him an accused in the money-laundering case.

Excise scam: ED opposes Kavitha's bail plea, says release to affect probe to unearth conspiracy
Enforcement Directorate (ED) on Friday opposed in the Delhi High Court the bail plea of BRS leader K Kavitha in a money laundering case linked to the alleged excise policy scam, saying her release would adversely affect further investigation to unearth the «deep-rooted, multi-layered conspiracy». The ED, in its reply to Kavitha's bail plea, contended that the Telangana lawmaker is a «highly influential» individual and stands accused of having committed a grave economic offence. She has the potential to tamper with evidence and influence witnesses, it said. «K Kavitha has conspired with other people and actively involved in payment of kickbacks to the tune of Rs 100 crore and then in establishing the money laundering ecosystem, that is, M/s Indo Spirits through her proxy which generated proceeds of crime of Rs 192.8 crore. By such acts, K Kavitha is involved in various processes and activities relating to proceeds of crime (POC) to the tune of Rs 292.8 crore,» the probe agency said in its counter affidavit. On Friday, Justice Swarana Kanta Sharma heard part arguments advanced by Kavitha's counsel and listed the matter for further proceedings on May 27.

PM Modi calls Himachal Pradesh Congress government 'talabaaz sarkar,' accuses it of shutting recruitment commission
Modi on Friday called the Congress government in Himachal Pradesh a «talabaaz sarkar» for shutting down the staff selection commission and said the party also intends to put a «tala», or lock, on Ayodhya's Ram temple. Addressing a 'Vijay Sankalp' rally in Nahan in Sirmaur district, the prime minister claimed a conspiracy is being hatched to snatch the reservation for Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs) and give it to Muslims. As Modi took to the stage, he chanted 'Bharat Mata ki Jai' and evoked local deities. Coming to Sirmaur felt like a homecoming, he said. «Neither Nahan nor Sirmaur is new for me but I have to say that today's atmosphere is new as I have never witnessed such a historic rally in Nahan,» he said.

'Hands-off approach' needed: SC refuses to direct EC to upload voter turnout data amid Lok Sabha elections
Also Read:Lok Sabha Elections 2024: 60% updated voter turnout in phase 5 polling, slightly less than 2019The court stated that it cannot issue any such directions at the moment as five phases of polling have concluded and two remain and it would be difficult for the poll panel to mobilise manpower. The apex court also adjourned the interlocutory application (IA) filed by the Association for Democratic Reforms (ADR) to be listed before the regular bench after the elections, reported PTI.The court pointed out that prima facie it appears the prayers in the application are similar to the main petition pending since 2019 on the issue."This (IA) has to be taken with the pending writ petition because in between the elections, a hands-off approach has to be adopted," the court said."Granting any relief in IA will amount to granting relief in the main petition which is pending," PTI reported quoting the bench. Also Read: 'Could be exploited…': ECI opposes release of booth-wise voter turnout data, files affidavit in Supreme CourtIt said it needs to understand the ground reality and not overburden the poll panel by changing the process midway. The ADR has filed an interim application in its 2019 PIL seeking directions to the poll panel that "scanned legible copies of Form 17C Part-I (Account of Votes Recorded)" of all polling stations be uploaded immediately after the polls. On May 17, the top court had sought within a week the Election Commission's response on the NGO's plea seeking a direction to upload polling station-wise voter turnout data on its website within 48 hours of the conclusion of polling for each phase of the Lok Sabha elections. Also Read: 'Correct star campaigners' discourses': EC raps Congress and BJP, asks them to

ocean acidification, etc, that are induced by anthropogenic greenhouse gas (GHG) emissions in the atmosphere? And secondly, whether state parties have an obligation to protect and preserve the marine environment in the context of climate change impacts, including sea-level rise, ocean warming and ocean acidification? The tribunal answered both points in the affirmative by deriving its jurisdiction on the issues within the UNCLOS.
