Judicial Magistrate Yashdeep Chahal, in an order passed on September 13, said the accused had appeared to join the investigation as and when required, however, «the LOC appeared to be a safeguard to ensure that judicial process is not frustrated in any manner». «Even if the applicants are directed to obtain prior permission of the court before travelling abroad, the accused could always travel without obtaining any such permission and there would be no way for the court to enforce a condition of that nature,» he said.

Supreme Court on Tuesday said mere existence of a benchmark disability of 40 percent does not bar a person from pursuing medical education unless there is an expert report that the candidate was incapacitated from pursuing MBBS. A bench of Justices BR Gavai, Aravind Kumar and KV Viswanathan gave detailed reasons for its September 18 order where it allowed a candidate to take admission in MBBS course after the medical board opined that he can pursue medical education without any impediment. The bench said the capacity of a candidate suffering from disability to pursue the MBBS course has to be examined by the disability assessment board. It said, «Mere existence of benchmark disability will not disqualify a candidate from being eligible for the MBBS course. The disability board assessing the disability of the candidate must positively record whether the disability of the candidate will or will not come in the way of the candidate pursuing the course.»

In another separate order, the court has also directed the lender to remove the company’s name from the list of ‘wilful defaulters’ and has also directed the bank to recall any information sent by it to any Credit Information Company declaring Pune Buildtech as wilful defaulters. “It is not in dispute that the entire settlement amount as mentioned in the Consent Terms (Rs 703.35 Crores) has been paid by the petitioners to Bank of India sometime in June 2024,” observed the division bench of Justice BP Colabawalla and Justice Somasekhar Sundaresan in its order of October 8. “Despite this, and after receiving the entire amount, we fail to understand how Bank of India could continue with the proceedings initiated for declaring the Petitioners as wilful defaulters after issuing a ‘No Dues Certificate’ to the petitioners (Pune Buildtech).”
