Adani Power, Dickey Alternative challenge NCLAT's status quo order in Supreme Court
Dickey Alternative Investment Trust and Adani Power Ltd on Wednesday moved the Supreme Court challenging the National Company Law Appellate Tribunal's order asking it to maintain status quo on implementation of the consortium's resolution plan for debt-laden Coastal Energen. A Bench led by Chief Justice DY Chandrachud posted the matter for hearing on Thursday after Solicitor General Tushar Mehta and senior counsel Abhishek Manu Singhvi sought urgent hearing in the case. While observing that prima facie due process was not followed and members of the consortium should not be allowed to make any gains, the NCLAT on Friday directed that the erstwhile resolution professional would continue to run Coastal Energen's power plant in Thootukudi, Tamil Nadu, until September 18, the next date of hearing. And any money generated during this period would be kept in an escrow account, it held.

TMC leader has criticised the agitating medics for defying the Supreme Court directive to rejoin work by 5 PM on Tuesday and has dubbed the protesting doctors as «anti-nationals». In a purported video clip, TMC leader Chandan Mukhopadhyay, a panchayat leader of Baduria in North 24 Parganas, was seen making the remarks at a party programme. The authenticity of the video could not be independently verified by PTI. «Despite the Supreme Court order, the agitating doctors are continuing with their protest. They have forgotten their solemn duty of serving the people. These agitating doctors are nothing but anti-nationals. Immediate action must be taken against such doctors who have defied court orders,» he was heard saying in the video.

SC to hear Glas Trust's plea over insolvency proceedings against Byju's on September 17
Supreme Court on Wednesday said it will hear on September 17 the appeal of US-based creditor Glas Trust Company LLC against a judgment of the NCLAT, which had stayed insolvency proceedings against ed-tech firm BYJU's and approved its Rs 158.9 crore dues settlement with the BCCI. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra was urged by a battery of lawyers that the plea be heard urgently keeping in mind the subsequent developments in the case. The plea was mentioned by senior advocate NK Kaul, appearing for the ed-tech major, that the case needed to be heard at the earliest. The submission was supported by Solicitor General Tushar Mehta, appearing for the BCCI, and senior lawyer Abhishek Singhvi, also appearing for the ed-tech firm.

NCLAT suspends insolvency resolution process against Essar Oil and Gas Exploration & Production
Essar Group entity Essar Oil and Gas Exploration & Production Ltd under the Corporate Insolvency Resolution Process (CIRP). On Tuesday, the division bench of Justice Ashok Bhushan and technical members Barun Mitra and Arun Baroka, while suspending the National Company Law Tribunal (NCLT) order observed that Section 9 Application has been resorted as a recovery mechanism which is not permissible under the IBC. “Appellant (Essar Oil and Gas Exploration) is a healthy company which has a turnover of Rs 800 crores and about 425 Employees are working,” observed the appellate tribunal. “Section 9 application ought not to have been admitted by the adjudicating authority and the adjudicating authority has in the order although noticed the settlement but has not appropriately dealt with the settlement,” noted the appellate tribunal in its order.

Coutts, Alta.Anthony Olienick showed no emotion while Chris Carbert appeared glum and folded his arms, as the sentence was read out in Court of King’s Bench on Monday.Neither are to serve their full sentences, as Justice David Labrenz gave them nearly four years credit for time they have already spent in custody.Both were convicted of mischief and possession of a firearm dangerous to the public peace, while Olienick was also found guilty of possession of a pipe bomb.A jury found them not guilty of the most serious charge they faced — conspiracy to murder police officers at the blockade.The blockade halted traffic at the border crossing for two weeks in 2022 in a protest of COVID-19 rules and vaccine mandates.The men were charged after RCMP found guns, ammunition and body armour in trailers near the blockade.Labrenz said while the men believed their cause just, they can’t be allowed to take the law into their own hands.“Both Olienick and Carbert used the blockade as a last stand against police,” the judge said in his sentencing decision.“(They) knew they were actively participating in something that was illegal, but they didn’t care because they thought their cause had been worthy.”He added, “The law does not allow people to take the law into their own hands.“Both men bear a high degree of moral culpability.”Olienick and Carbert have been in custody since they were arrested in February 2022.Prior to sentencing, they were given a chance to address the court.Carbert declined, but Olienick said he is a better man as a result of his time in custody.“It has given me time to indulge in God’s work,” he said, reading from a prepared statement.“I will continue to help others.”Olienick was given six years for possession for the

Clause 6 of Assam Accord: State govt to implement recommendations of Biplab Sarma commission, focus on safeguarding Assamese identity
Assam chief minister Himanta Biswa Sarma said that thegovernment has discussed on the recommendations of Justice (Retd) Biplab Sarma Commission, which was constituted by the Ministry of Home Affairs, Government of India, to implement Clause 6 of the Assam Accord. State government will in consultation with All Assam Students Union (AASU) will implement 52 by April 2025. Sarma said that there will be regular meeting with AASU. “There will consultation with sixth schedule councils and people in Barak valley. However, for implementing these recommendations in Brahmaputra valley we do not require any consultation with this bodies.” Assam government stated after detailed consideration, Cabinet has accorded approval to implement 57 out of the 67 recommendations made by the Commission. For the remaining 10 recommendations, in-depth discussions will be held with the Government of India. These recommendations will be applicable across the State except 6th Schedule areas and Barak Valley. In these regions, the recommendations will be implemented only after concurrence of the authorities and the people in those regions.
