RG Kar issue: Junior doctors continue sit-in outside health department office amid rain
junior doctors in West Bengal on Sunday said they remain steadfast in their resolve to pursue justice for the medic raped and murdered at the RG Kar hospital, a day after another attempt to resolve the impasse with the state government fell through. Amid persistent rain, the protesting doctors continued their sit-in outside 'Swasthya Bhavan', the state health department headquarters in Salt Lake, for the sixth consecutive day. «We are steadfast in our resolve to seek justice for our sister, no matter the adversity. We have spent nights on the streets in harsh conditions and inclement weather despite some of us not feeling well,» an agitating junior medic said. Chief Minister Mamata Banerjee had on Saturday made a surprise visit to the site where the doctors were protesting and assured them that their demands would be addressed, but the proposed meeting fell through, with the protesters claiming that they were asked to leave «unceremoniously» after waiting for three hours at the gates of the CM's residence.

Allahabad High Court, in a significant judgement, has ruled that a Hindu marriage is not to be dissolved or terminated as a contract. The sacrament based Hindu marriage may be dissolved (in law), in limited circumstances and too only on the strength of evidence led by the parties, it said. Allowing the appeal filed by a wife against dissolution of marriage, a division bench of justices Saumitra Dayal Singh and Donadi Ramesh was of the view that even in «granting the divorce on the strength of mutual consent, the learned court below may have dissolved the marriage between the parties only in the event of that consent continuing to exist on the date of the order being passed».

'Prudent girl' won’t go to hotel room with stranger: HC acquits man accused of raping minor
Bombay High Court has overturned the conviction of Rahul Lahase, a Jalgaon man accused of raping a minor Class 12 student. The court's decision was based on the notion that it is unlikely for a «prudent» girl to accompany a stranger to a hotel room on their first meeting. Lahase had moved HC against his conviction and 10-year rigorous imprisonment sentence handed down by a sessions court in Amravati in November 2021. The High Court's single bench, led by Justice Govinda Sanap, questioned the credibility of the survivor's testimony and found her version of events implausible. According to the prosecution, Lahase met the minor girl on Facebook in March 2017, coerced her into a sexual relationship, and later blackmailed her by threatening to share explicit photos. The survivor also claimed that after she ended the relationship, Lahase shared the intimate photos with her family and fiancé.

NCLT withdraws nod given earlier for merger of Zee and Sony entities
NCLT) has withdrawn its approval for the merger scheme between Zee Entertainment Enterprises and Sony Group Corporation's India media entities, Culver Max Entertainment and Bangla Entertainment. The order passed by the Mumbai bench of the NCLT on September 5 brings the curtain down on the failed merger deal that could have created India's second-largest media and entertainment company, rivalling the proposed Star India-Viacom18 combined entity. Zee had filed an application with the Mumbai bench of the NCLT on August 29, seeking recall of the NCLT order dated August 10, 2023, sanctioning the scheme of arrangement.

Coaching Centre deaths: Delhi HC grants interim bail to four basement co-owners
Delhi High Court on Friday granted interim bail till January 30 to four co-owners of the basement of an Old Rajinder Nagar coaching centre where three civil services aspirants drowned in July. Justice Dinesh Kumar Sharma, while pronouncing the verdict on the bail pleas of the four accused, said the relief is subject to the co-owners depositing Rs 5 crore with the Red Cross. The judge said the conduct of the co-owners is «unpardonable» and an «act of greed». In the order, a request has been made to the Lieutenant Governor to constitute a committee under a retired high court judge to ensure no coaching centre is permitted to run without permission. The authorities should also carve out a place for coaching centres in the capital, Justice Sharma added.

Adani Power and Dickey Alternative Investment Trust to continue to operate Coastal Energen's 1,200 MW-thermal power plant till the National Company Law Appellate Tribunal (NCLAT) decided various appeals against the approval granted to the resolution plan for the debt-laden firm. However, the apex court said that the Adani-Dickey consortium, the successful resolution applicant (SRA), would not dismantle the Coastal Energen’s power plant in Tuticorin, Tamil Nadu, or create any third party rights or create any financial obligations except in the ordinary course of business. The Bench led by Chief Justice D.Y. Chandrachud said that “prima facie, we are of the view that the September 6 order (of NCLAT) suffers from internal inconsistency. The first part indicates status quo ante has to be restored and the second part shows status quo has to be maintained as on date.”

Justice Shakdher further explained that the platform would allow users to share courtroom anecdotes, provided they adhere to standard operating procedures (SOPs). He stressed that the anecdotes should not name individuals and must remain within boundaries of decency. “We need not be very sensitive and need to learn to laugh at ourselves,” he added, hinting at the need for both lawyers and judges to embrace the occasional levity of courtroom exchanges. He also mentioned that he had considered naming the initiative the «funny bone committee.»

Status quo on Coastal Energen resolution challenged
Adani Power and Dickey Alternative Investment Trust approached the Supreme Court Wednesday, challenging the National Company Law Appellate Tribunal's (NCLAT) order asking the companies to maintain a status quo on implementation of the resolution plan for debt-laden Coastal Energen. A bench, led by Chief Justice DY Chandrachud, posted the matter for hearing Thursday after Solicitor General Tushar Mehta and senior counsel Abhishek Manu Singhvi sought urgent hearing in the case. Observing that prima facie due process was not followed and members of the consortium should not be allowed to make any gains, the NCLAT on Friday directed that the erstwhile resolution professional would continue to run Coastal Energen's power plant in Thoothukudi, Tamil Nadu, until September 18, the next date of hearing. Any money generated in this period would be kept in an escrow account, it ruled.
