A bench of Justices Surya Kant and Ujjal Bhuyan listed the plea for hearing on September 25 after senior advocate Abhishek Manu Singhvi, appearing for Sharad Pawar faction submitted that they want urgent listing of the matter in view of the assembly elections in Maharashtra. Singhvi said that till the matter is finally decided, both the groups should be given new symbols ahead of the Maharashtra Assembly elections. Sharad Pawar has moved the apex court against the February 6 order of the Election Commission recognising Maharashtra Deputy Chief Minister Ajit Pawar-led group as the real Nationalist Congress Party (NCP).

Members of Parliament or Legislative Assembly are disqualified if they are found to have defected from their original party on whose ticket they were elected.

The matter was assigned to Justice A S Chandurkar as 'tie-breaker judge', after a division bench in January delivered a split verdict on the petitions challenging the amended IT rules. Justice Chandurkar on Friday held that the rules violated constitutional provisions. «I have considered the matter extensively. The impugned rules are violative of Article 14 (right to equality), 19 (freedom of speech and expression) and 19(1)(g) (freedom and right to profession) of the Constitution of India,» the judge said.

A bench of Justices Surya Kant and Ujjal Bhuyan directed the Haryana, Uttar Pradesh and Delhi governments to apprise the court of policy, legislative and administrative changes made to prevent a repeat of such incidents. It said uniform initiatives should be taken in the entire National Capital Region to prevent another Old Rajendra Nagar-type incident from happening. «If the need arises, we will pass directions for pan-India to prevent Old Rajendra Nagar-type incidents,» the bench observed.

Bombay High Court has directed Apollo Tyres Ltd. to stop circulating advertisements that allegedly disparage CEAT Ltd’s car tyre variant ‘Crossdrive AT’ until further order, granting temporary relief to the RPG group-owned listed tyre company. In a recent order, the court said that CEAT has made out a strong prima facie case for the grant of ad-interim relief in its petition, alleging that some advertisements for Apollo Tyres’ variant ‘Apterra AT2’ shared through YouTube, Instagram, X, LinkedIn and Facebook portray ‘Crossdrive AT’ in a negative light. “The balance of convenience is in favour of the plaintiff (CEAT Ltd),” Justice RI Chagla observed in his 16-page interim order. “Unless reliefs as prayed for are granted, the Plaintiff will suffer irreparable harm/injury which cannot be compensated in terms of money.”

Supreme Court on Friday asked the Centre to provide information about the numbers and names reiterated by the apex court Collegium for appointment as judges in higher judiciary with reasons why they were not considered so far and at what level they were pending. The direction was passed by a bench headed by Chief Justice D Y Chandrachud while hearing a PIL seeking a direction that a time limit be fixed for the Centre to notify the appointment of judges recommended by the Supreme Court Collegium. «The Supreme Court Collegium is not a search committee (for judges) whose recommendations can be stalled,» said the bench which also comprised Justices J B Pardiwala and Manoj Misra. The bench asked Attorney General (AG) R Venkataramani, appearing for the Centre, to provide it with a list of names reiterated by the Collegium and say «why they are pending and at what level».

The petitions urged HC to direct the civic bodies and police to refrain from granting permission for the use of such high-decibel sound systems. The PILs claimed that neither the Quran nor the Hadith (holy books) prescribes the use of DJ systems and laser lights for the celebration.
